In 2004, we began the process of buying an apartment from AIFOS, in the block called "Las Conchas", on the Hacienda Marina, complex at Benalmadena. This particular block was never built.
In 2008, we were told that our block was not going to be built and that Aifos did not have any money for refunds, plus we did not have a Bank Guarantee, and that our only course of action was to sue AIFOS, which we did, and in 2009 we "won" our court case and we were awarded a full refund, which turned out to be a tissue of lies, as we never received a penny.
In 2010 we were put on the AIFOS's Creditors List, and in 2012 we were told of the latest offer from Aifos, which comes "without any form of guarantee" and will only refund 45% of our deposits. This 45% will start to be paid once the offer is agreed, which could be 2013, 2014, 2015, no one knows ?????, then we must wait a further TEN years before receiving the first payment of one-sixth of the total. Each following year we will receive another one-sixth, until all six payments are received. For example If the offer is agreed in 2015, then we will not receive any money until 2025 and the last instalment will be paid in 2030 !! Which means that someone will have had my life savings for 26 years !!
Since both my wife and I are OAP's we can ill afford to wait this time, so taking all things into consideration we would like to ask ANYONE who has any information regarding the details of the Banks involved in funding AIFOS on this complex.
Unfortunately our original lawyer failed to include any of the Banks details in our Sales Contract and since we dispensed with his services he ignores our requests for information.
