Eighteen apartments for sale:-

After I received a private message on EOS I did an internet search. The Dutchman who contacted me said he was about to RENT on La Condesa but wanted to know if all my issues with the developer were now settled..

Can they sell the properties on which unreturned deposits are still outstanding??

 If the previous contract is still not cancelled and due amounts have not be returned, they cannot sell / rent the property to anyone else.

What if:-

a)  the contract was cancelled?

b) a court case stated instructed the developer to return the deposit?

c) the developer ignored the judgement and did not re-pay the deposit?

If the developer is free to ignore the judgement then what is to stop him selling/renting the properties?

He can apparently do as he pleases.

a)  the contract was cancelled? If there is an agreed or Judicially stated cancellation, he can sell or rent

b) a court case stated instructed the developer to return the deposit? He can sell or rent, you can embargo its benefits, even though I would encourage you to use the route against the Bank.

c) the developer ignored the judgement and did not re-pay the deposit? He can sell or rent, you can embargo its benefits, even though I would encourage you to use the route against the Bank.

If the developer is free to ignore the judgement then what is to stop him selling/renting the properties? Answered above.Do not fix battle against against developer now the contract cancelled, use the Guarantee which was used in this development.

He can apparently do as he pleases.

Thankyou Maria,

I am awaiting the outcome of the Finca Parcs case and the return of their deposits before I commit to a further court case.

We are on fixed income and cannot afford to borrow money for a court case the outcome of which is far from certain.

Your comments however are appreciated and we understand that we still have options in persuing thge return of our funds.
