What if:-
a) the contract was cancelled? If there is an agreed or Judicially stated cancellation, he can sell or rent
b) a court case stated instructed the developer to return the deposit? He can sell or rent, you can embargo its benefits, even though I would encourage you to use the route against the Bank.
c) the developer ignored the judgement and did not re-pay the deposit? He can sell or rent, you can embargo its benefits, even though I would encourage you to use the route against the Bank.
If the developer is free to ignore the judgement then what is to stop him selling/renting the properties? Answered above.Do not fix battle against against developer now the contract cancelled, use the Guarantee which was used in this development.
