Query re claims against Banks with head office in Barcelona
The Comments |
I wonder if Maria could advise if there are any unforeseen legal risks associated with ongoing or outstanding claims against Banks who have head offices based in Barcelona, given the current political situation?

No Hugh I have no idea, hence the question.
I'm wondering if Supreme Court rulings that have taken years to establish and clarify with regard to Ley 57/68 and Banks legal responsibilities will continue to be respected and honoured?

No problem as, in the hypothetical case Cataluña were finally an independent country, the matters which are and would be decided happened when those facts were under Spanish Law.

Ads,
I would think if there were any problems with any companies which areb trading nationwide they will transfer to "mainland" Spainç I believe San Miguel (beer) may have done that already.

Thank you Maria.
My concerns relate to protectionist action relating to Banks who might refuse to recognise prior SC rulings and how the State of Spain will manage this without causing yet more hardship to those in the process of seeking timely justice according to the clarified law, Ley 57/68.
If this hypothetically were to occur, would any protectionist action of this nature be in breach of the rule of law, as banks in Catalunya, by trading in Spain, have to abide by their laws and SC rulings? Is this what you mean?

I mean that those banks were, when facts originating liability happened, under Spain Law and European Law.
In any case, major banks having law 57/68 liabilities have already moved their registered office to other provinces in Spain. See Caixabank in Valencia and Banco de Sabadell in Alicante below.
