Changing from Apart Hotel Permission to Residential

I have purchased an apartment 10 years ago which had permission to be an apart hotel and not residential. My lawyer never spotted this.

It has never been much of a problem until now. Because as a result no one in the complex is allowed to do short term lettings

I am told that there are apartments which have had a similar problem and been able to apply for their permission to be changed from apart hotel to residential

Does anyone out there know anything about this or have any experience of making such a change

Your help would be appreciated.

Hello MarAzul321,

I have no experience of your specific problem, I don't expect many folk do.

But you may be better off speaking with your neighbours first to obtain their views and see if you can enlist their support for whatever action you decide.

I've spouted long and loud on here and other forums regarding the pathetic legal standards in Spain.  Of course there are exceptions, but most should carry a warning on their headed notepaper "Using this firm may seriously affect your wealth!".

A firm in Mazarron cost me €10,000 through their simple stupidity, when I complained to the Spanish Law Society I discovered that the person who screwed up wasn't actually a qualified solicitor, even though her name was on the door!  Good solicitors in Spain are very few and far between and there seems to be little meaningful regulation.

Despite this you may want to consider action against your solicitor.  The 10 year time period since the purchase took place may not be a barrier.  I was told by another Mazarron solicitor that in Spain they do not have any Statute of Limitations.  I still find this surprising and possibly erroneous, a lot seem to make it up as they go along.

Maria the lawyer who sometimes contributes on here may offer some advice, which I'm sure would be useful.

But as I say if you really intend to take action I would start by raising the matter with your neighbours - perhaps at your next AGM?
