What is the longest long term rent commonly available?

Hi there, My family and I are in the process of selling our home in England and will be moving to the Playa Flamenca / Villa Martin area.  I have heard that if you rent a property for 12 months or more then you have more rights to the property than the owners and therefore most people do not rent out for over a period of 11 months.  As we would like to rent long term into the future does anyone know if most letting agents will extend / cancel and renew your agreement to allow you to stay in the property that you have settled, obviously assuming the owners still want tenants?  As we want it to be our family home we don't want to have to move house every 11 months!

Your advice would be appreciated!

Also if anyone has any 3 bed properties in these areas or the Orihuela area that you would like to rent out on a long term basis with a view to extend then please let me know!  I anticipate our move to be the end of this year!

Hello

We run a rental business on the Costa del Sol and all our contracts are for 11 months on a Arrienda de Temporada contract which is a short term temporary contract. Although there is no limit it normally doesn't exceed more than 1 year, with most agents stating 11 months. The other type of contract in Spain is a Vivienda contract but these are rare as they are renewable for up to 5 years and owners are very cautious of these. The reason why the temporary contract is used is to show  the intention of impermanence so that the tenant does not establish full rights.

However many owners are happy to renew each 11 months, providing that you have been good tenants and paid the rent etc!. We currently have a tenant that has been in the same property for 3 years. A new contract is drawn up each time. Obviously there is a concern that the owner will not renew but unfortunately it is a risk you will have to take. Before you move in anywhere try and find out what the owners intentions will be at the end of the contract and if they would be willing to renew.

The relevant aspect for a rent to be considered a home-rent and therefore enjoy the privileges for duration is the statement of not being a seasonal renting, regardless the time agreed. A rental contract for three years can be considered a seasonal renting if that is expressed in the contract.
