Reposesion in Spain

Hi everyone,
I have got a property in spain but I am having some problems with it.
The tenants did not pay rent for 8 months and for that I could not keep on with the mortgage repayments.
I have been sue but a date is not set yet for the hearing.
I have now borrowed enough money to pay for the 8 months plus interest but the Director of my bank (La Caixa) wants me to pay for the legal fees too. And he is refusing to take the money.
Can anyone who know the spanish system advise me on this please?
Remember, I have only been sued but a heairing has not taken place yet.
Please, please, help!!
I will appreciate any personal or profesional advise.

IMHO, unless I'd bought the property more than 5 years ago I would probably threaten to refuse to pay any money at all i and let them foreclose, which will take a while and then cause them to lose far more than 5k if they have to dump it on the market. Can a Spanish bank pursue you for the money in the Uk if they do? Maybe, maybe not, I'd check - they may just have to write it off, but if you have to borrow the money to pay the mortgage you can't afford the property anyway and if it reached that stage you may have to declare yourself bankrupt

Hi Seme965 - you should have a look at the thread Bank Repossesions in Spain Explained - I've just moved it up the screen.
If the bank or the court incurs any costs then you are the one to pay - no-one else - and they can pursue you in the UK.
