Hi Maria,

Once again I am asking for your help.

Last year we got my money back from the builders of a development that they decided not to build. as we were still keen to buy in spain we found another place that was for sale and agreed a price with the sellers .The agent agent we used said he would arrange for a mortgage and act as the go between.he asked us for 1000 euros which he said the sellers had asked for as a security deposit.This was to be refundable if we could not obtain a mortgage. We have a receipt to this affect signed by the agent.

This agent made many promises to us and said that the Mortgage had been agrred in principle by the bank. We started finding him difficult to get hold of so just before christmas we contacted the seller who were very surprised to hear from us and said that the property had been sold to someone else as they had heard nothing from the agent since we agreed the sale and had assumed that we no longer wanted to buy the property.They were not aware that the agent had taken 1000 euros from us.

We are very angry with the agent who we feel lost us this propery.We doubt that he ever tried to get us a mortgage as no search showed up on our credit report and despite asking him on several occasions,we never saw any paperwork.

He is now ignoring our emails and phonecalls asking for our 1000euros back.

This guy was working for an agency but said he was setting up on his own so signed the receipt in the nameof an agency  that we dont think existed.

What we would like to know is how can we get our money back?I know its only a small amount but We dont see why he should get away with ripping us off. Is there a small claims proceedure that wont cost an arm and a leg.?

Also, Can we  post his details on the site ?as we would like to warn others about this crook..

Hi,
I would just like to share this with you as it may give some hope to the many people who have paid deposits only to find that the build is late or not going ahead.
We put down 42000 euros on an off plan development which was to be completed in july 2008.We only found out afterwards that it did not have planning permission.
Being a bit naive we did not obtain a bank garauntee. The bulders then said it would be the end of 2009 before completion.

We went over in the summer and confronted the builders who then admitted that the build was not going to go ahead.  After a series of shouting matches on the phone they agreed to return our money.
For some reson we had to go over in person (which we did last week )to collect the cheques. and sign a cancellation contract which of course asked us tio sign away our rights to any further claims.
So they sat on our cash for over a year.and we hads to pay £500 to flyt over to collect it.
On reflection, looking at some of the other people in our position we should consider ourselves lucky to have got it all back and as the pound has slipped against the Euro so much since july 2007 we have made a few bob on the exchange rate.
We would like to thank Maria De Castro for all the sound advise she has given us. and pointing out what rights we have and what courses of action we would have to follow to get a refund. I'm sure her letters to the builder have helped to prompt them into giving us a refund.

Can anyone advise on what monthly figure we should expect to pay for joint life cover for a property we are planning tov buy for 145000 Euros.

the bank has valued the property at 180000euros.

.I am 54 and my partner is 46.
