Another victory for purchasers

A new victory for purchasers this week, this time in San Roque (Cadiz) Courts. A  developmnet company  voluntarily acquiescing to our lawsuit, acknowledging on   the rights of consumers in an off plan development. 

This recession times are time for keeping the battle up for those who has been abused for a long time... it is true that developers have short cash flow now but they do have assets, lots of assets... to back their liabilities.

The most important thing is that  good legal defense by lawyers in favour of consumers will produce Judges failing in favour of them and  creating  a strong body of Case Law with the right orientation in these cases. A new legal conscience and full respect to the weak parties.

Another brilliant result Maria. As you say, keep the momentum going and put these powerful and abusive developers rightly in their place.
It is time the tables were turned in favour of the lowly purchaser, without who the developers are now realising (well at least I hope they are realising) they are stuffed!

Hi Maria, I think you already know of Grupo Urbasa, I put 25% down in 2004 approx 170.000Euro on 2 properties at the Merdian development Benissa near Alicante, kept asking my legal adviser for bank garantee's and receipts for land registration but they never came She in fact kept the fee in her bank account for 3 years without advising me because she had issued a letter confirming it was safe to transfer the funds which it was not as the land belonged to a third party, she now wants me to issue legal proceeding against both Urbsa and the land owner,of course this will cost more money do you have a any suggestions
