Legal tip 470. Electronic Justice Act in Spain

Council of Ministers have just approved the proyect of the Technological Justice Act, the aim is the processing of judicial procedures through electronic ways in its entirety.

The project has been enriched by the contributions of the General Council of Judicial Power, The General Attorney, the General Council of Lawyers and the General Council of Procurators.

This Act is a result of the e-Justice plan of the European Union and facilitates relationships of citizens and professionals with the Justice Administration. The Justice Minister assures that a more accessible, transparent and dynamic Justice will be achieved with the introduction of this Act.

Electronic data transmissions and database keeping of the same will take the place of the old paper notices and archives.

Citizens will have the right to choose the electronic way and professionals will be under obligation to the use of the same which will drive to the fully electronic management of judicial claims and therefore more efficient and dynamic processes.

The new Act also includes a set of information about criteria and recommendations on safety, keeping, normalization, formats etc..., and a minimum common ground for different computer systems to be compatible and fully functional. These criteria will be managed by a National Public Committee on Electronic Justice formed by members of the Justice Department, Regional Justice Authorities, General Counsel of Judges and General Attorney Office.

Thank you Maria.
Although this is a welcome reform, the proof is in the actual application of law as per successful judgements.
All too many are still waiting to witness a Spanish justice system that applies the law in a fair and timely manner. Those who have outstanding cases and await recompense as per their successful judgements remain vulnerable and understandably angry that the government is not taking immediate action to ensure that the consumer is protected.
Only when this happens will we ever be able to say that trust has been recovered.

Dear Anne:

I fully understand your frustrations. Those clients of us who are suffering the delay the most are those which not were provided with Bank Guarantees. So, I would say that the effort the government needs to do in in regards to 1.2 of Law 57/68.

In fairness, I need to add that the finantial crunch and real estate crisis have also made an impact for delays. This is not a judicial but a financial issue.

Maria, Sorry but I have to disagree with you there as all too many have cases dating back way before the economic crisis struck and even then the delays were prohibitive as developers, etc, "played the system"!
We innocent clients cannot be made the scapegoat for the incompetence within the Spanish justice administration system not should we pay the price for political interference between local and regional councils, etc.
The game is up now and we all have to focus on gaining recompense from our successful judgements, and being secure in the knowledge that our consumer rights are ultimately protected through a fair and competent justice system without political interference, otherwise it just becomes a worthless and costly exercise.
