Would it be possible that as many of the purchasers as possible could meet on site together to get some answers from the developers.  We all seem to be operating and making visits individually, and keep getting told the same old story, ' completion is due next week',  I have lost count of the number of times we have been given that line.

Just an idea anyone interested?

I agree with you, but thats not allways practicle,we both went out there at the begining of october with the intension of installing our furniture and completing after being told by Maria that our snag list was completed and "we are getting the ocupation licence any day now, so yes book your flights and when you get here everything will be rosy" only to find out that not only is she a very lazy mare, she also tells lies as frequently as Mary Dunn, trying to get any true information out of her on the phone is useless.

A year or so ago, before we found out about this web site, there was a person who talked a lot of common sense and offered to front a joint action for all of of us. I expect like myself, Mary Dunn would'nt give him  our email addresses under the guise of data protection act,but this person as persued this cause.

This action is not a no win no fee basis!!!.

But seeing has their are quite a few who are willing to take the attitude " well we can all chip in and it won't cost that much to provide gym equipment ,plants/shrubs and after all we have the best complex around". Well all of us including the ones with that attitude, should join this person and litteraly thank this person for all the hard work been done to present this case,its not too late to join.

Some of you know of this person. I spoke to this person reciantly and i have the utmost respect for standing up and fronting the whole issue, and at this moment i would like to add that it is not anybody who resides presently on fsa.

Too many people are devided on this issue,and are ominous by not writing on eos, and this is what fsa are laughing at. If we all get together including those who have allready completed we can get to the bottom of this.

This will run on like this for as long as we let it, come on lets get together.

I am Maggie Wilkinson and have been in my apartment, No. 40, for a couple of months.  Yesterday I checked with the Town Hall and FSA have submitted the paperwork confirming they have made all the alterations required by the Town Hall in order to grant the licencia de primera ocupacion.  This is in the technical department.  Once they have approved it (probably within the next two weeks I am told) it will go to the general council which meets once a week.  I was informed we should have it approved by Christmas. 

Incidentally, the lawyer of Neil Hay contacted me last spring asking if I would be interested in a joint action, but I have had no further news from him.

Actually, we may be able to get out there over the Christmas holiday period.  I do have children however who have to go back on January 3rd and also am extremely anxious about the lack of security there especially in the underground carparks.  I will be travelling on my own with 3 children and after our burglary in the Summer, we are a little unsettled at the prospect.

I am not being supportive of the developers, but i think at this stage of the ocupation licence it will run its own course, if Mijas council decide to drag their heels because of some dissagreement with the developers in the past, there is nothing we can do about that. What are we going to do,once we get out there enmass walk around with placards or barge into victors office only for him to tell you what you want to hear?. This action may ease your frustrations in the short run besides being costly!!.But in the long run what we, we being the collective word for all of us that hav'nt completed can do, is band together legaly and either jointly, get a lawyer,or get your own lawyers, to force the developers to stick to the original agreement, ie gardens finished, gym completed, trees planted all along the rear road as shown in their plans submitted, and also shows on the fronts of the contracts we all signed. Also a firm assurance that we as the community will not be involved cost wise in the road intergration.The developers have broken their side of our contracts not us, so therefore we would'nt be illegaly breaking ours. I myself have sent Maria, Victor and Chillion copies of the above and asked them to give my lawyer written assurances that all that work and the small amounts of snaging to be done before i complete and i will sign straight away. But up to this afternoon myself nor my lawyer have heard nothing,i have rang Maria up several times, sometimes she answers some not, she says she has passed my messages on to victor,wether i believe her is another matter. No i peronaly think the only way we will get things done is by doing the above action.The people who have signed already ca'nt really do much, they were told 9 months ago the licence is coming tommorow. BUT WE CAN !!!!!!!,besides i do'nt like bacon butties.

Hi all

Had a short break in Benalmadena last week to view progress and to meet with solicitor. I have posted some pics, including the work on the roundabout in front of the complex and the generator facility.

We were pleasantly surprised with our apartment as last time we visited in April the kitchen wasn't furnished but now sported fridge freezer, microwave, cooker and hob and in the utility room washing machine and sink, plus the water and electricity were on albeit the electricity was on generators.

Maria told us the plans to obtain the habitation license had been re-submitted to Mijas Town Hall and were awaiting appraisal, but the meetings were only conducted on Fridays and no one could tell which Friday!

We were introduced to Victor while in the office and he confirmed that we could hear any day that the license had been granted.

Our solicitor still advised not to complete until the license was in place.

As you can see from the pics the development looks superb from any angle that's why we're prepared to wait however long it takes.

Have we all considered the facts before we are asked to sign and complete on our contracts.

If the developer does not fulfill his obligations and give us what is in our contracts, who will meet the shortfall.

Can you imagine the conflicts this will cause, some will pay, some wo'nt.

Then in the case of them that wo'nt, will they be able to ride on that or walk there?.Them that will, most of the time will resent them that did'nt. Them that have wo'nt be able to force them that hav'nt, because the developer has breached their contract. Will those who did try to stop them that did'nt?

Comments on the above gobbledegook please.

Folks

I have only today come across this message board, and am only sorry I didn't see it before ! It sounds like my position is very similar to many others - won't complete until there are assurances that everything we signed up for is in place, and anyway can't complete as the mortgage company won't consider it without the license of first occupation. I've asked my lawyer what action I might consider, but individual action is unlikely to lead anywahere. I would be happy to give support to any action that is proposed to escalate this, if indeed the LOFO is not granted in the next month.

I don't have the freedom to travel at short notice, (based in Bermuda), but have been considering a trip to try and escalate things. If any others are planning similarly, it would be great to collaborate on timing and objective !
