Just a quick line to find out if anyone purchased through Pauline at Regency Homes. We have tried to contact her to no avail. We would like to know what course of action other Regency clients are taking, are you sticking with the lawyer that was reccomended by Pauline (there should be a few?) We were told that her clients were given a FREE bank guarantee by San Jose! Any imformation would be appreciated at this time.
Pauline, if you are on this website, then we would appreciate a call just to answer a few questions and try to set our minds at rest

I dont know Pauline but will make some enquiries for you.
You will need to check your lawyer requirements quickly and get your claim logged with San Jose at court. Did you get your letter to confirm your credit at court? Also do you have a copy of a bank guarantee in your possession?
Also do you have any idea of others in the albatera buy.....i am in need of as much info as possible myself

I have purchased through Regency Homes and Pauline is on Business till 16th July I believe in the UK. The solicitor used through Regency is Venancio Parra Torres based in Torrevieja. I'm sure Pauline can supply more details on this upon her return.
Just to let you know then I am requesting my funds back via Bank Guarantee and solicitor for the 3 x properties.

I am requesting return of funds for just one property through a solicitor, but have no bank guarantee.
If you have any info over the next few weeks including an idea of the numbers still left at Albatera, funds left, San Jose contacts or anything really, i would love to know Steve.

I have a letter from Regency Homes stating that San Jose gave us a free Bank Guarantee to the solicitor Venancio Parra Torres but the email I received off him yesterday says they never received it!
Haven't received credit letter either, who sent you that?
Please can you all tell me what solicitors you are using, and how did you go about getting Power of Attorney etc. I just don't know who to trust, do we go with Venancio Parra Torres who Pauline recommended or not. Would love to know who you are using if you don't mind.
Please please please reply today as we have been told we have to get information in by 30th July and we have only just found out about this so in a real panic

We have gone with Martin at Abolex....the solicitor. i will place his details at the end of this mail. Using the same solicitor that regency have messed up with is perhaps not a good idea?
I arranged power of attorney in my home town...google up notary and your town or nearest city, then contact them. Martin could arrange to get you represented with the credit.
We received letters from the administrators to confirm our credit with San Jose...its in Spanish...everything you have to do at court is in Spanish, they dont accept English. We dont have a guarantee though, even though its a legal requirement.

Hi all,
San Jose Inversiones filed last friday its "voluntary bankruptcy" in the Mercantile Courts in Alicante (as published by "Informacion" newspaper).
All those with credits against this company should be aware that it is very important now to find an experienced Solicitor in bankruptcies and property, in order to defend your credit inside the bankruptcy process.
We are currently joining different creditors and assuming their representation, as the more we are, the stronger we become. Most of them are buyers of the project in Jumilla that can now see how their savings may be in high risk.

I am in the same position as I have just returned from holiday to try and sort a solicitor. I am also wary of using a solicitor related to agent/builder so will be trying to find out costs from Martin @ Abolex. The ESTIMATED costs from Venenacio I received from Pauline are below:-
Amount of Deposit Estimated Fees
18,000 –24,000 € 833 € + 16 % VAT
24,000 – 60,000 € 1,013 € + 16 % VAT
40,000 – 60,000 € 1,428 € + 16 % VAT
60,000 – 100,000 € 1,853 € + 16 % VAT
100,000 - 120,000 € 2,553 € + 16 % VAT
120,000 – 200,000 € 2,903 € + 16 % VAT
Over 200,000 € 4,203 € + 16 % VAT
There will also be an additional fee for a Barrister which is estimated to be approx between 300 € - 500 €. You will be required to pay 30 % of this fee up front when giving your instruction to Venancio to represent you.
I was informed I had a Bank Guarantee but have not seen anything or ever heard I had one since 2002 so don't believe it. I have spoken to another purchaser who bought direct in Sweden (Max Nyman) so there are 4 of us so far! I have received the letters from the administrators but now need to sort Power of Attorney, documents and payment receipts details to a solicitor that isn't going to charge me an arm and a leg :-(

Excuse my ignorance here, but if we are already on the Creditors List submitted by San Jose, why do we still have to pay a lawyer thousands to get it back for us, if it has already been submitted for us??? probably being totaly naive here, but my head has gone!!!

I had the same thoughts and angst...then i thought can i afford not to be represented,,,,,,and i went with Martin after talking to around 3 other lawyers.
I have Martins price list......probably not right to place it in full view but when you get yours i will compare with you. I paid him 1500 euros but it seems it may be cheaper if there is no concentrated litigation.....i will be getting a refund from him.
Im down the road in Barnsley.......

Hi All,
We bought a property in 2002 in Albetera trough Sun and Golf Homes and they gave us a solicitor to represent us,(not a good move for us)
After waiting 5years for our house we had a enough, so we went with a different solicitor in Alicante that was in Jan 2008.
He stared court precedents to get our money back and in May he went to court in Torrevieja, then San Jose said they wanted us to attend Court that was in June , we went to court and the jugs found in our favor , he gave us damages for ( 12,000 euros) plus our deposit of ( 54,000, euros)
That not all, then we found out that we had a bank guarantee with our old solicitor , it had a expire date of ( 01,08,2008 ) nice surprise to us.
So our new solicitor tried to get our money back from the bank, but there was a problem ,when we bought our property we wear not married, so the bank guarantee had my wife maiden name on it, and they wanted proof that she was the same person.
So off to the notary again in London to swear that she is the same person.
Now they want the original bank guarantee so we have sent that to them trough our solicitor and are waiting to see what will happen next. the bank is( CAM BANK )
We don`t know if this helps anyone , our solicitor is not cheep but he is good ,and as they say you get what you pay for.

Hi guys, I dont post on here very often, but thought I'd comment here. Pauline mailed me yesterday with some instructions but I was already on with this anyway. I'm getting a power of attorney sorted with a notary at bhp in durham city. They seem pretty switched on and he's done a few recently - what a surprise.
Venancios team are ok, they just need a bit of prodding. They seem to know what they are doing and he's meeting the administrators next week. Pauline tells me he'll be in court in the next few weeks. We got our bank gaurantee (which seems to gaurantee naff all) straight away in 2006 no problem.
We have also married in the interim but we actually got Lynne a new NIE when in Spain this May.
I appreciate we arent buying at Albatera, but sympathise with anyone who's had to deal with our friends at San Jose.

It was just a hello, how you doing sort of thing....but I found it a bit surprising after a year of complete radio silence.
Just wondered if I was in a unique situation or if they have surfaced and are in touch with all ex / current clients.
And what peoples opinions are in general.
