Hi our names are andy and ruth ,we are purchasing mar y sol block 1 apartment f ground floor front next to the pool. When we went to the builder we were told that the roof pool was for our use and the pool next door was for the bungalows only but it seems that there is great confusion over which is which surely somebody can resolve this or is it a race to the nearest pool, the next thing will be geting up at 3 in the morning to place beach towels like some other country we wont mention.

Hi, You must have the apartment at the front, as ours is ground floor rear. I have to say that I can't see the pool bothering us much, but we were told when we purchased that the pool next to us was for our use. We were also shown an illustration of a much larger pool without that huge pump room at the end, the roof of which is about level with the floor of the first floor apartment. We now have a great wall at the end of our terrace, which we definitely were'nt expecting! As you say, surely its's not beyond the wit of someone of the organisations making a profit from this to settle the issues.

I would'nt worry to much about it, i think these pool will hardly get used, going off the other pools on the development , i have'nt seen more than four people around them at one time, but i am sure it will get sorted out. Alan

The pool at the end of the bungalows is solely for the bungalows. On the original plans, the block on the other side of the pool did not exist. There was supposed to be a green area, and then another row of bungalows, until the prospectof a lot more money changed the builder's mind. The builder then arbitrarily extended to the pool wall, annexed a bit of the surround, and added the top floor!
The bungalow owners' community administrator (Community No. 617) is already trying to extract payment for the pool from us, but until it is properly finished, they can whistle for it.

I was saderned and disapointed to see the message i posted on the 8/12/06 had been posted onto a formentera forum on the 18/12/06 by a fellow member, breaking the terms of this website, just because the member did not like the content of the message. it was later removed by the administrator of that site.
I don't think that is the way to get any issues sorted

The information concerning the pool was not posted elsewhere because the content was not liked. Not all of the users of the other Formentera sites(s) know about this one. It was posted in order to try to inform as many Formentera owners as possible, concerning what was taking place in their absence.
Personally, the pool is of little interest to me, except that I have to pay towards its upkeep. I agree that very few people will actually use it, so if more owners have to contribute, the less it will cost each individual.
More significantly, I don't believe the builders are impressed by single visits to their office; and for each owner to individually consult his/her/their solictor to sue the builder would collectively cost far more than if we were to act together, using one solicitor.
But if you don't circulate the information widely, you won't receive support from owners who don't know what is taking place.

I don'T want to look like I'm sideing with the builder, but to be fair the pool on the ground was never intended to service just 32 properties it was more like 64 or more,
so i cannot see how a dozen or more units makes that much difference, but that is just my opinion.

It would appear that the builder says different things to different buyers. Our Community administrator set the pool charges based on 32 owners. There was no suggestion that additional owners would be asked to contribute - as the builders were not supposedly going to build on the 'green area'.
It has also been suggested to me (not from an official source) that the builder did not apply for permission to build the extra ones, increase the block height, or put in a roof pool.
I have emailed our administrator, and president. So far, though, no reply.

I have bought my apartment jointly with my son, i have worked in construction all my working life and he is a royal institute land and building surveyor, we don't just listen to builders agents, and we definitely don't listen to rumours.
