I am delighted that tommy seems to have received his deposit back albeit at the time without interest. Tommy have you received the interest back yet?

We are currently suing Mena to return our deposit plus interest.

What experiences have other people had?

Hi Jabulani,

We have given up trying to get our interest back, our lawyers said we would have to pay them 3000 euros and then they would take Mena to court but even then it is not certain that we would win the claim, Spanish judges seem to be in cahoots with the developers rather than the innocent Brits. 

We are just grateful we got the deposit back considering the trouble other people seem to be having getting theirs.  Pretty soon phase 2 will be finished and Mena won't be returning deposits, they will be demanding the final balance.

What stage are you at with your court action?

We are a large group of investors who are suing Grupo GPS at the nearby Marbella Hill View Development in La Mareina. We recruited an independant firm of very experienced litigation lawyers and they have just submitted all of the papers to the courts. Its proving to be a very costly process but anythings better than having to complete on this awful development!! It could easily take up to a year for the action to take its course through the courts. We are not over confident of success but we have done our homework, gathered the evidence and we shall fight this third rate developer all the way............................
