May be but in his answers to James Lynch he is suggesting people who are worried about their refund should put into bricks and mortar and as EBCC is not being built he is suggesting transferring... how can he do that??  And in transferring there may be additional costs... who would handle that.?

OVP have been operating from rented/leased properties for years... Longdon Hall doesnt belong to them

I really hope that you are right and that we are all getting our money back in March this would be absolutely marvellous.  I do have to let you know that we have been given dates for the sale of our properties in Morocco on numerous occasions and as soon as the date approaches the goal post is once again moved, like I say I hope you know something we don't but to be honest I wouldn't hold your breath.  We were promised sales of our properties July 2008, October 2008 and end of November 2008 and guess what were still waiting when they went into Administration so I guess absolutely no chance now, more chance of making a successful cup of tea in a chocolate teapot.

I have to say I'm amazed that anyone still honestly believes that SBS are going to facilitate a program of refunds for EBBC buyers.  Why on earth would you think that this is genuine following almost 4 years of deceit?  There is a level of naivety on this forum which astounds me. 

I don't want to piss people off so please don't reply with a barrage of abuse, but it is really time to face facts.  The money is gone. There will be no refunds in pounds, euros or anything else.  Barracking the Directors or ex-Directors of OVP or the administrators directly is a complete waste of time.  You need to be taking sane and logical steps now - it is farcically beyond the point of inaction and hoping that a ridculous rumour will hold true.  If you haven't already then please;

 - Contact a good solicitor; preferably dual qualified in English / Spanish law & investigate other ways of claiming for your loss

 - Provide all the evidence you can for the fraud investigation; OVP may be in administration but this does not stop its employees from being charged

 - Write to your MP to encourage pressure from Parliament; within 1 week my MP had initiated several calls to action for both the police & Government Insolvency Service

Contrary to TrickyVick's concerns that 'kicking up a fuss' will 'ruin it for the rest of us' - this is the only likelihood you have of seeing any sort of satisfactory conclusion.  It would be frankly barmy if 4 years on any of the investors on this site were not kicking up a fuss; but please do it through the proper channels.

My case is in the hands of a solicitor and has been for some time. I too do not actually believe there will be any refunds, its just another in a very long list of lies and deception maybe its being done to waste time, I dont know. My reason for participating in this forum is mainly to vent understandable frustrations.

I have watched this forum for the pass year without making any comments.

However I feel said company has everyone running round like headless chickens.

Tricky Vicky you sound like a plant working for said company, if you are not I apologise in advance.

The simple matter is we were all told money was going into an escrow account. Then  from within the walls of hell(said company) we were told money was in joint account with developer and said company. Now they tell us it is with the developer.

Now they say they will pay money back in Euros not sterling?  Bull shit all the time.

They have been playing for time shifting assets etc, however the net is closing in. Its a matter of people coming together to help the police with their investigation. Yes said company maybe in administration but the directors can be held responsible and senior staff.

I know of another case with a different company (very similar to this)  and there is warrants out for peoples arrests directly involved with fraud. This by the way extends across Europe.

Said company is still trying to get people to shift to other properties and would have us believe there is only a few of us looking our money back. There is a lot of problems with other developements and developers may go bust and not be able to complete on these developments.

At the end of the day said company had a duty of care to all of us and will not give us our money back. Don't worry I know of plenty of poeple who will come forward as witnessess.

We may or may not get our money back, however justice will be served one way or another. This is starting to get the attention it deserves and if money is not paid by March I would assume people get onto more national newspapers, contact MP's, police and TV.

All monies coming in have to go to the court appointed administrator to dish out to creditors. Its BULL%%%T. TrickyVicky Speak to your solicitor and get his angle on it if you haven't already. I would love to beleive that they were going to refund all the monies. They say its coming from a 3rd party who is willing to buy our interests up if we are not satisfied. They will not state who this 3rd part is though. I do not beleive its a savvy investor who sees a good thing! Police will deal with directors of OVP. They want you to transfer to another development and use up stock they have on the developers shelves... Choice is of course yours and if you take this option then good luck to you. Get a proper valuation on it first and make sure you can get a lender to provide the mortgage before you sign anything. Speak to the developer and confirm that he will reconise you as a client also.

I haven't posted in a while because, like most people who invested in property either for business or pleasure, I am in shock about what has happened to so many people who put their trust and hard earned cash into their futures. I am one of them.  We were all seriously misled by the information given to us at the onset and for the most part none of us did the due diligence required in such a purchase but we relied on the honestly of the solicitors in the UK, the honesty of our Spanish solicitors, the developers and the banks all recommended by the company we dealt with.  This is how all of the money all over the world has disappeared and it is called greed and fraud.

As far as I personally am concerned I can't wait until some heads roll and people end up in jail for fraud and although there has been much printed in the local press in the UK it doesn't seem to really have prevented more people doing the same thing.

I would like to suggest to all of those of you who are being offered a new property somewhere else that you do not accept but that you go and get your money back if you can.  You have to weigh up what has happened to you already which is: you have probably waited 4-5 years for a property which didn't materialize, you have nothing to guarantee the next property (unless you know differently), you will be thinking you can rent or use your new apartment when it is built (none has materialized yet) and you will have nothing but aggravation for years to come setting up your apartment services, snagging, etc.  Just look what you might already have gone through. 

If you are young, in work and can leave this behind and wait for a refund then my own thoughts are that you should.  If you are pensioners or wanting to retire you will still have to wait 4-5 years before the Morocco properties are fully up and running.  Why don't you invest in something that is already built in a country which is treats you and your money as if you count.  Clearly Spain's time is over as regards these new builds as there are hundreds of thousands of them to be finished.  Spain has not made it easy for the tourist with all the high property taxes, etc., etc.  You know how it goes and the red tape in buying there is horrendous. Everyone believes they are escaping the UK weather, etc. etc. but imagine how many vacations you could have had with the money you spent on Spain in one building and all the costs incurred for it.

Lastly, I would like to thank this forum for always letting us vent - we are aware that it was not set up for that purpose but it most certainly has allowed people who share a common problem to come together with a view to trying to resolve it.  Individually nothing can be done but collectively something might be achieved and I hope it is for everyone who has lost track of their money and has nothing to show for it.

For those of you still phoning or writing to OVPI - they don't exist anymore.  For those trying to find CUK and Spanish solicitors - they are all gone.  If your solicitors can find them you might get some satisfaction and money back but who knows.

It is not in doubt we will HASTLE these people until we have justice. When we are taken for mugs with all this crap about using a UK company we can trust, who will ensure our money is protected, there is no doubt this matter will not go away. SBS - tell everyone by post about the refund scheme - Euros/Sterling -?? - it does not matter. (ok it does matter - don't respond anyone).  Do a mail merge and send the handfull of remaining non-transferees/those who are happy with the situation a letter - dust  off the computer that was so good and sending out the update  "wihout prejudice" letters and send us some more with a request for the bank details to send us our money to. It sadly seems Tintin is correct and other too (listen to Tintin everyone).  There is a lot of money unaccounted for.   The real administrators - please have a look and trace the money received - if you suspect anything is wrong, report it.

Of course if the refund scheme is starting in February and I am wrong -I apologise. Of course, any comments are said "WITHOUT PREJUDICE"  - see above - I think it means I can say what I like and it does not matter.

Anyway, I am looking forward to the the refunds in Feb 09, whoops,  March 09 , oh I mean, April, no last year blah blah blah

Is TrickyDick seriously implying that SBS are on our side??????? Get real... OVP have set up a new Limited Co. in SBS. Surely another way to make a profit from others misery?? I'm glad TrickyDick has given up..... Good riddance....

No one seriously believes that posting on this forum will result in a refund but people need to vent their frustrations etc and know that they are not suffering alone.... There is also the fact that via private messages we can/have got together through lawyers etc etc etc

You're quite right, I presume that some of us do not understand the issues surrounding Administration as we have probably been lucky enough to avoid Criminal types like the ones who headed up OVP. The honest, law abiding amongst us can only hope that what goes around comes around and hope it comes around quickly.

The current comments are obviously not helping anybody at the moment. I believe we should keep our solicitors on the case and see if the money starts in Feb/Mar 09.

TrickyVick, I'm sure the the directors, senior staff  of OVP/SBS would like to bog off, but unfortunately that isn't possible any longer. The criminal investigation has started, I know for a fact that they are very interested to see if refunds are given as agreed. Do you not realise that whats happened is illegal? Money has vanished! OVP have stated that Miranda has it and he states that they have it.

I agree that we should not hound them at this stage but if money is not returned in the next 6 weeks, I will fight until the bitter end and I'm sure 99% of investors will be with me.

TrickyVick - I really think you need to appoint a solicitor.  This situation is way beyond trying to deal with OVP / SBS or anyone else directly.

There are considerably more things that I and my fellow investors have discovered during this legal investigation - and I can onlly assume it is because you are not in this process yet that you still believe there could be a pot of gold at the end of the rainbow.

Perhaps you can explain to us all as you seem to be such an authority......how come if the courts insisted that a company be formed (SBS) that SBS was formed on the 9th Jan (according to companies house) yet the court case was on the 12th Jan ??

Does anyone know if the fact that OVP's holding company is still active offer any hope?
