Hello,

In 2004, I signed up to buy a property in a different development but it's all gone horribly wrong. AIFOS sent us a cheque for our money back and we contracted to buy a house elsewhere (Not from AIFOS). Then the cheque bounced. I engaged a lawyer who has secured 2 embargos. As a result, AIFOS have offered me the comleted property which I have embargoed in this development with habitation licence etc. The thing is I do not want or need another Spanish property.

I think the embargoed property we are being offered had a private contract of 235k (the original buyer has secured a different property).Would 235k be about right - I don't know how much they were selling for off plan? Anyway if it is, I am being offered it for the price I was to pay on the original deal - AIFOS can't sell it unless they pay me off first. I have read on this forum that there are people who are worried that their property will not be built. If there is anyone who is buying who was paying that much, then it may be possible to come to an arrangement. I would have a property I don't want, and if the original private contract was originally 235k, I may well be able to release it to someone for that price less what they have paid to AIFOS. That way I get my cash and they get their property for roughly what was the original price.

I don't really want the property but I will buy it if I have to to avoid losing a truck of money.....

The embargo is on a first floor 2 bed in Lila block.

I am trying to switch to a penthouse (as that is what I was originally buying ) but Aifos want more money as they are saying these properties are much more expensive than where I was buying.

About the highest price for a 2 bed in Lila on the first floor (not penthouse or roof terrace etc), was approximately 180,000 in 2004?

Having bought a ground floor apartment in2003 with a sea view and been shown the next door apartment in Jasmine which had a wall in front of it in October 2007 I would personally not believe anything Aifos says or does - don't believe what they say they are worth, they are only worth what they are able to sell for which is not a lot at the moment!

Over recent years we have come across many people in Andalucia who could not get their money after giving a deposit in order to buy a house. Some of them with final judgments requiring to the developers their money back (when normally the promoters have already broken), others without bank guarantee and a few who have decided to give back their homes in exchange for ridiculous amounts.
