This is irregular practice and if you are getting a mortage the bank will certainly not release funds to give to your solicitor prior to completion. All final payments are dealt with at the time of signing at the Notary's office. As people who have bought property in Spain over the years, commercial and residential, our strong advice to you is to change the lawyer as something doesn't smell right here.
Our lawyer has been representing us since 1988 on the Costa del Sol so if you would like to run this past him, send me a private message and I will give you his details. He is local to Arenal Golf, his office is in Arroyo de la Miel and he speaks perfect English as does his secretary who is English but married to a Spaniard. His office closes for Christmas on 22nd December until January 2nd.
By the way we are buying in Block 11 Phase 4 too and have been told by Arenal in Marbella Head Office that completion would be end March 07. We are buying from Arenal direct and they have not asked us for any money prior to completion.
Who did you buy your apartment through and was this solicitor recommended by them?
