Any news for court cases with no BGs

A small number of cases have gone to court and seen judgements against Huma and the period to pay has past with nothing - except the need for another court appearance.

Have any of those cases now gone to the next court stage to try and force Huma to pay? 

Has any solicitors got any further with how they can seize assets? I do not think Huma (Med or Indalo - whatever you call them) has any money!  Huma have a history of not paying people (agents commission, etc) - so I do not think we are the only ones in the queue. I wonder why building really stopped @ OTCC?

There is a lack of info on the forum about anyone progressing any further currently. I think we would all like a bit of encouraging news from someone out there!! I fear that good news is sparse! Someone prove me wrong!!!

Meanwhile - Huma seem to bumbling along. No shock to see OTCC has stopped and Huma saying it will start again soon - deja vu!

Seems now the only way forward  for all is court for those without BG's. Poor OTCC people will have to wait to start their cases until their contract runs out (or will they hang on again like ACC - I would hope not!). I just get more and more depressed about all those entangled in this!

Nothing to report on the court front - still waiting for a first hearing never mind a second one!  To quote my solicitor "The Court in Murcia is quite slow and also we have had an strike in Spain again in Courts that is making more delays."

Your comments re OTCC are spot on - even Senor Rowlands is thinking he'll have to resort to court action!

There are rumblings about a new development partner for Huma but we'll see...

I know I didn't like MCC but I think those who opted to swap ACC for a key ready property in MCC are laughing compared to us.  At least they have had time in their place in the sun!

The information i have at the moment is if Huma are forced into receivership/liquidation anyone with a judgement against huma stands to get 50% of there money back,that is of course what you have paid out in deposits, then of course there is the legal fees and court costs to get to the point that you have a judgement against Huma,

Question is how come no one has issued proceedings to force them into bankrupcy,do they get paid at the 11th hour?

our next court date is end of april , huma did not turn up for the pre-trial hearing in dec

davies& co  says huma may not turn up again but he has won a case in the same way

he has put a freeze on a mcc house huma own and will put it up for auction if huma refuse

to pay the deposit back to the buyer...............its so dont give up hope.....fight the con men.

Hi all we have had a court date from Miquel for the 25th March has anybody else got this date ?

Also we have had an email from ITV Homes From Hell, saying they have had lots of emails about this and they will reply  ASAP so lets hope they can help.Perhaps if more people get in touch they might do something.

Ref the  freeze your  solicitors  have put  on the house at MCC,  I heard that  all  the  properties owned  by Huma  were mortgaged.  So  if  it  goes  to  auction - the  debt  remains  with the property, or  does  the  money from the  sale  go  to the Mortgage  Company?  Interesting!!  Anyone  got  any  answers?

Any proceeds from a forced sale would firstly be divided up between the first charge-the mortgage company/bank then any other 2nd line charges secured on the property.

Then of course if the bank have a debenture on Humas assets i think they get to keep the lot as the bank will hold the deeds to the mortgaged property and woud obviousy get first bite!

But he was going to get a BG and secure his money, it would be built by June 2009 or some such date around the corner.
