We got our money back last year. This included the deposit and £50,000 first payment. We used an excellent Spanish lawyer - Isaac Abad, who speaks good english and has offices in Murcia and Mazarron. If anyone wants his contact details please let me know. Isaac kept in contact with us throughout the whole process and even threatened Huma with the bailiffs when they failed to make the payment on time. Isaac was recommended to me by someone who had problems buying elsewhere in Murcia and I can't sing his praises highly enough.

Could you possibly tell me how to contact Isaac? We are about to start the process of establishing a full refund and would like to do so with as little stress and hassle as possible!!

I've never heard of this Isaac......Pablo Abad Anderson is the owner of Andersons.
I'm not recommending Andersons or any other Spanish solicitor - they're all cr*p or corrupt as far as I'm concerned

Hi Lisa, I think my remark was self explanatory! Advice - well if you want details on Isaac you might try a p.m. to adc as requested and also ask if they had a bank guarantee as it's much more likely to obtain a refund with one. Further advice would be to look through the postings for the last two or three years then go with whatever option you choose to suit your own situation.

Thanks for that! Obviously there isn't an easy or straightforward way to a refund! Have tried not to get stressed over the past 5 years but I can see it coming!!!

I promised the optimists that I would n't post here again.
Sorry to them, but I just popped in for a look to see if anyting has happened. (does that make me an optimist?)
18 months down the line, I doubt if my info would be of any use, but Andersons got us our money back.

Andersons have had a split in their partnership after Pablo Anderson was involved in property deals that went to the wall leaving the company owing a lot of money. Don't know who is looking after their clients now but we paid 25000 euros up front before all of this happened, so now we have had to look for another solicitor.

Does anyone know if this developer has actually refunded a single penny back to anyone from their very own bank account ?
Why is it that each and every person ever involved in the purchase of a property on ALMANZORA COUNTRY CLUB CUEVAS is having to fight for refunds either via bank gaurantees or court litigation ?
It really is a disgraceful way for a company to act and how they ever believe they can remain in future business is a complete mistery.

Up to a couple of years ago people were getting their money back when their contract ran out no problem. I think at that time HUMA felt they could sell the sites on again as soon as they got planning permission at a higher value. Since the recession started and it became apparent that HUMA were not going to get planning permission in the short term they stopped paying out. Unfortunately it takes quite a while to go through the court but I think in the next few months HUMA will either go under or people will begin to get their money back - via embargos on properties etc.

I think the best you can hope for in getting any monies not secured by B.Gs is that Huma get all the paperwork in place to finish what they have started at Almazora Country and that your solicitor has secured security on those propertys ,that way you stand a chance.
If they are forced under i think there will be much less of a chance and any refunds will be diluted,considrable.

I think you may be right. The only chance left is to get a debt placed on the propertry in the hope that if it's ever built / completed you can place that obstruction in the way against a re sell. (new buyers would soon be running scared if they find out).
So you twould hink it would be in Huma's best interest to settle any refunds sharpish !! Then pigs might fly ...........................

Michael Davies from DaviesAbogados recomended that we should not purchase at Country Club. We ended up purchasing somewhere else. and we are very gratefull for his advice.
We have remained in contact with him. He is handligng a few cases agains Huma and he tells me that:
Clients with bank guarantees are having no problem in getting their money back , but that the clam must be presented before they elapse and that they must have the originals. He has handled a few and all succesfully.
Up to a couple of years ago he got money back for clients even withought bank guarantees and withougt going to court., but that the only solucition now if one does not havea BG is to go to court as soon as possible.
He now has a few cases going trough the courts . In two cases he has allready received sentences ordering HUMA to pay lall money back plus interests and court costs. In one of those cases he has allready put an embargo on a property free of charges belonging to Huma (under it´s previous name Huertos de Mazarron )in Mazarron. In the case where the clients have obtained the embargo on a property free of charges he says the clients are home and dry.
Michel Davies used to be the HONORAY BRITISH CONSUL , and is highly recommendable.

Couple of interesting comments here:
1) Your solicitor believes HUMA actually has the money to pay you back. If this is the case then this is good news for everyone. I would agree with your solicitor that if HUMA have the money they won't let the property go to auction - I am not convinced they actually have the money.
2) I presume the property they are putting an embargo is a bungalow at MCC (correct me if I am wrong) - if that is the case then the value of 80,000 euros (I would say a reasonable valuation in todays market) is substantially less than what they were offering these properties to ACC people at 'special rates'.
When is the property you have an embargo on due to go to court?
