A recent libellous posting on this forum has been brought to our attention so this is a message for Trudy & Mark Hanley. As we do not wish to add to your burden at the moment we decided to give you an opportunity to retract your statement regarding Villaquest S.L. and to also put into print a full unreserved apology. Failure to do so will result in our being forced to ask our lawyer to take the appropriate steps regarding your defamatory remarks.
We would also like everyone else to know that, contrary to your inflammatory postings as to when you bought your property etc, we can ascertain that you purchased in July 2005 when construction was continuing at ACC and was not forced to cease until November. Until that stage we, nor any other agent, had any idea there were problems. That is why we recommend you have a solicitor/lawyer who should run the appropriate checks. If asked, agents will suggest a lawyer but do not force you into using them. Plus, your agent was Focus not Villaquest S.L.
Furthermore, Villaquest S.L. is an independent estate agency, we work with a large number of developers and promoters but are not privy to any inside information from any of them therefore can only advise our clients as to how we perceive any given situation and relay information as and when we receive it. This we did, and still do, for our clients plus any others who contact us. We did try to help you during a number of telephone conversations however; you insisted you wished to cancel the contract when we then advised you to use the correct channels to obtain a refund. At that stage it is totally out of our hands as the proper channel is via your solicitor and your agent, Focus Estates. In fact, you thanked Villaquest profusely for their help during our last conversation.!

Oooooh , a massive can of worms you have opened there !
One thing I would say is, please remember that many many people are in a desperate situation over ACC. Fighting with agents and the developer to get THEIR money refunded. Money parted with in good faith as per contract. The contract then became void for non - delivery of the property in the agreed time frame.
But, some have no bank guarantees, many going into litigation and waiting court dates.
This forum is a way for many to express them selves, pass information to each other, and discuss the plight we are ALL in. (The serious plight)
Please put your self in their / OUR position. What what you be doing to get a resolution......?

You mention in your post about purchasing in July 2005 when construction was under way !
What has that got to do with the fact that these propertise were being sold by agents WITHOUT the correct planing licences in place ? I have no idea about your selling policy so will not comment on specific agents but use the generic term, but that is why via the Junta and the legal court construction was stopped on this development.

Dear Me,INFAMMATORY POSTINGS no less,how awful for them!!Well,chew over this one,Parador Properties AKA ( Parador International) these days.showed us the ACC site on the last day(before we flew home)took us STRAIGHT to a P/P conected Lawyer in Vera,hung about while we did the buisness ie.handing over 625E.The name of lawyers,I hear you ask,Aldea Advisors of course! we were then driven back to Campomore Golf Hotel very late in the day(back approx 5.30pm) we were introduced to the Parador money men,yep,youve guessed it Currencies Direct,yet another link to P/P.I spent the rest of the evening in bed with a lot of ice,with a migraine,mostly because our REP had driven us around in 3rd.gear,no stop for lunch,must get that sale and commsion,old boy!!! the following morning it was a quick trip around a market,then we asked to be taken to the airport,almost 4 hours before the flight,just could not stand to be with this rep any longer than neaded.That was then GOODBYE to our DEPOSIT,fairwell STAGE PAYMENTS,WONT SEE YOU LATER.Parador,A/Advisors Currencies Direct wash their hands,all except for C/D asking for transfer of money,and Parador asking for 425E "to keep us up to date with building works!" I find the fact that agents who are selling properties are not able to find out if they are legal absolutely amazing!
Obviously a solicitor should be able to check this out, first thing to do I would have thought.
So many of us went by the book - Reputable agents, independent solicitor, first class builders -
Maybe agh you could tell us what went wrong?
Who is to blame for an illegal build? Who is to blame for no bank guarantee? Who is to blame for it taking so long to take this matter to court for the return of our hard earned money?
Yes it's probably ourselves for being too trusting. What an expensive mistake!

yea! same happened to us. went through parador and was met by Robert Schoulz at the vera office, brought around the place. everything was perfect and looked perfect. thought it was a dream. went to vera and the offices at aldea advisors next door....they share the same toilet in the building through a connecting door, believe it or not. was told everything in order. signed up. then a letter 6 months after to say all is lost. the surprising thing is, our first stage payment of 30k was signed over after the government closed the place down. they said they were not made aware of the closure......And they were supposed to be acting for us.
Can anyone tell me who are the lawyers acting for HUMa
As for the threats well as Wellington said 'Publish and be dammed' Why should we be kept silent. we've been f****d over royally! with no recourse from HUMA, Parador, (or whatever agents were used by people) and our lawyers who never spotted the fact that they had no licence in the first place....Come off it!

You should be ashamed coming on here and try to defend your company. You were quick enough to introduce people,the same as Parador to an illegal build...never mind the nudge nudge, wink wink it will be passed eventualy.
Why don't you return your commission to the people you introduced to Huma?
I don't think you will get far threatening honest people.
How come you have not taken an action against Huma....the reason is.... They are too strong for the likes of your company so the poor lone purchaser suffers again.
Shame on you and your company for your posting.

I was fuming when I saw this - but I sat back for a couple of days - so I did not reply with four letter words everywhere!
Huma were acting illegally and anyone that missold as an Agent was an accomplice to an unlawful act. Ignorance of the law is no defense!
Agents acted illegally by selling ACC. It is the responsibilty of Agents in law (well UK law anywhere) selling to ensure what they are selling is illegal.
The Junta said it was illegal - as simple as that! Huma did not have the planning licences and a court order stopped the building by enforcing the planning law.

Tell me where in your literatue you say that you cannot vouch for proper planning in place and do you point out explicity to the client in writing and verbally to check proper planning permission is in place - as you know it was practice at this time to turn a blind eye to planning and most Agents were in on it.
A word of advice - a libel case is very difficult to take in the UK and extremely expensive and you would have to prove damage unfairly. Your chances are non existant - I suggest you contact your lawyers before threatening people. I think a 100 people would turn up as witnesses of Agent neglect in any Court case - you could fight that! Tell me when the court case is and I will organise all the people! We might organise a demonstration against your offices in Spain too - how about that for a threat!!
You have done yourself no favours and harmed your reputation by posting here! I would not deal with you (In fact I will tell peopIe not to deal with you in future) I think many will now do the same!
Any agent dealing with ACC or Huma have a lot to answer for!
If you have commissions for sales on Huma or deal with other agents that did - why not you and them give them back to the clients - that would be something to post! That would show you are fair minded!
In future - do not post warnings - just go to court! No one has any time for Agents and friends on Huma on this forum!
Huma have 20-30 million euros of UK clients -only a small % have had refunds of some sort - many are owed £50-£60k + and no BG and no sign of getting it back! Of course we are angry and resentful!

What an excellent idea,for agh------- for them and all other UK Agents to return the commisson that they have all been payed,via us, very gullable customers (before we report them to the Trading Standards Office) I am taking my info to the local office of T/S who are local to P/Properties in Surrey!! They will do as a starting point.So keep up the good work agh,we are all with you!! Not,Not Not, EVER. Kind Regards,Bagpuss.

You say your lawyer will ' take appropriate steps'
I would say to you and any other agent who has 'introduced' ( this is the term you use for conning ) people into buying what you advertise as HOMES BUILT ON LAND CLASSIFIED AS URBAN AND RECEIVED FULL PLANNING PERMISSION you should take the advice of some the other posters on this site and refund the commission you have already pocketed to your clients.
As for legal action ---- BRING IT ON !!!!

I'm sure we would all welcome some legal action, maybe the only way to get Huma and associates to court.
I don't know why these Huma agents keep posting on this site unless it's to apologize then we just aren't interested.

hi all,still here, still in the same boat as everyone else.
yes i can hear myself cry bring on the court action,but deep down i know it means sod all here in spain,the banks will not back up huma,they too seem to have had enough,
huma have no cash(or they very good at hiding it)it means nothing if you win in court,if huma go under the banks will be the first to claim anything thats left in the pot,
we will be still in the same situation,owed cash by huma,angry as hell at the people who got us into this mess,yes parador and the rest,how do these people sleep is beyond me,and come on parador ect ect take me to court,sue me,you wont get any money from me,HUMA GOT ALL MY MONEY.

Can anyone tell me how parador was allowed to get back on it's feet and trade away after all the crap that went on at ACC. I thought that the U.K. authorities were clamping down on this kind of thing.
