Finally after nearly 6 years we received most of our money back from Huma, Thanks to a phone call made by Jose Garcia (who was extremely helpful ) we found out that Huma had settled our case and paid money to the courts for us 3 years ago . After a lot of correspondence and phone calls this money was located and we received it Friday . We havent received any legal costs or court cost yet but are hoping too as our solicitor was able to seize some accounts of Huma`s and we are hoping when these are released it will cover the court costs. We didnt have a bank guarantee .! So dont give up keep fighting you still have a chance. good luck to you all Alfie.

Well done, congrats, delighted for you at long last.
i have been into my solicitors. i hope to have my money back by next week. will keep ypu posted.
PS: All I can say ast this stage is...Pickle was right all along.. Anybody got news of him/her?

Good news all round. What steps did you take Alfie?
I have instructed my solicitor to start proceedings but I keep getting told that we are waiting for a court date. That's over 2 years in the waiting. I have an email dated 10.03.2009 in which I am told that the court in Murcia is quite slow! Ground to a halt I reckon.
How long did you have to wait for a court hearing?
Did you sign a cancellation with Huma?
Did you get compensation?
I hope you don't mind me asking

. We went to court about two years ago.Miquel was acting on our behalf .Apparently we won our case, but we are still waiting for our mone,y so god knows whats gone wrong .We dont actually know if miquel is acting for us because he hasn't replied to our emails .He wanted more money to freeze assets but still wouldn't gaurentee to win.Im about to email yet once again to see if he replies i want answers to whay he hasnt chased the courts to get it sorted.I'll let you know the outcome.

Reading the latest postings i have concluded with what information i have and personal experiances that Huma numerous years ago were giving refunds without court action then court action was required, funds were fasr running out at this point and now we are at and have been for some time that Huma are ignoring the courts as they do not have any free funds availabe.
The only chance of getting your money back is if you have a b.g, then this is paid by the bank if you dont then its a long and expensive route your solicitor will take with little or no chance of getting any money back!
The next thing you might be offered is again costly and with little or no chance of success,a property embargo!
The only glimmer of hope is action against the banks for not providing guarantee,s and as far as i am aware still to be proved as being a success.The solicitor will insist that a court judgement against Huma is firstly required to show you have exhausted all possiblities against Huma!
Conclusion: Very early action was required. Bank guarantee,s the only proven way of a refund costly action with an unproven outcome against the banks for none provision of Guarantee,s !

I believe that test cases are still being explored by the legal profession against the banks with no set outcome at this stage and knowing how long the courts take i think it could be some time yet.
If this action is a sucess trust me those solicitors that you havn,t heared from or have not returned your calls or e-mails will suddenly find a renewed interest in your case with the chance of more costly legal action that you will have to pay for and you once again will become the grandious client!

I have no bank guarantee, my case hasn't been heard (as far as I am aware) so it seems that I would not be able to get a case heard against the banks anyway.
In truth, I can't understand what there is to argue about. The law clearly says that the bank guarantee must be given and that it is the bank's responsibility. It also states that the money has to be paid into a ringfenced account and can only be used for building the property...
On that basis, the bank that I paid the money to owes me a bank guarantee and all of the money I paid in plus interest at 6% pa.....
Reckon I'll do tonight's Euromillions. Probably got more chance of winning that!

Hi Guys,
This will probably be my last posting on this site. It finally happened. I got my money back. Two heart attacks, 1 broken relationship, 1 nervous breakdown and hospitalisation, but it finally happened. It has come back. I have no doubt that in the back of my mind HUMA have no problem in paying back all the money now as they have what they wanted. They had all out money locked in thier banks accounts for over 8 years, pleading that they had nothing. I have no doubt that the real reason that they are eager to deal, is that somewhere is some samll office, an agreement has been reached for planning permission and they will start the ball rolling again someday.....But for me, I've had enough. It has taken its toll. I wish every one of you all God's peace and the hope that someday, all will come right for all of you.

Good for you les, i'm so happy for you. Just hope we all hear some more good news, we are going through the the same sort of thing, the stress is too much to bare, and something no one deserves. Well done to your solicitor.more than we can say about ours who dont even bother to reply , what goes around comes around though .Good luck in the future in all you do.

This is indeed very good news. Les and Alfie I am so pleased for you both it must be a wonderful feeling to know this saga is over for you. It also gives the rest of us a very, very small glimmer of hope.

Reading Les's note below, if his incling about Huma possibly getting planning permissions is anything to go on then we need to be ready (all of us that are owed money) to make things as difficult for Huma to sell (re sell / redevelop) your original ACC plot.
The debt remains on that plot and passes to any new purchaser. I can't see any NEW purchaser touching the place if they know Huma still owe refunds on it. Can you ? Too risky for any buyer?
HUMA, if you read this forum - then PAY UP ALL refunds IMMEDIATELY or you will never re sell on ACC.

Hi Trudge,
Certainly is quiet on here. Clearly it's just the same - waiting and waiting, something we have all become used to over the years.
I keep hoping someone will have some good news so pop on here from time to time. The general forums are always interesting though and we clearly aren't fighting this alone.
