Hi,
Just had a bathroom tile fall off the wall, crack the bath and damage the shower screen. If my insurance company fail to pay out due to poor workmanship has anyone claimed off the 10 year gurantee we get with our new build? Any advice.

Would be interested also if anyone has details of the 10 year guarantee, I have not been given any information about this. We have recently had a gas leak on the pipe between our meter and the house, the insurance company are saying we are not covered and the community and Roda also both deny any responsibility. Cheers

Not sure anyone can actually supply details of a 10 year guarantee on your property, as it seems to be yet another one of those promises verbally given and generally accepted as gospel, until you try and claim.
If you have any paperwork with your contract, all well and good, otherwise you will have to try and deal with someone at Roda, assuming you can find anyone who is willing to offer help.
Some owners have been told the 10yr guarantee only covers walls etc. but not roofs, when they try and claim for leaks, so it may well be a flexible feast.
Tiles falling off walls and leaking gas pipes appear to be definite builder problems, not Community or Community Buildings Insurance
Perseverance and maybe a little legal advice may well be required.
There used to be an OMIC dept. around the corner from San Javier Town Hall who would deal with consumer complaints and supposedly offer advice but you would need to look into this.
Sorry I cannot be more helpful. perhaps others have more knowledge.

Update insurance company have visited and more or less said that the tiles fell off due to poor workmanship and will not pay out due to the 10 year warranty on all new builds, GREAT!!!!!! I would lobe to know what they actually pay out for!

I think the aftersales (probably a strong word for it) was initially based in Calidona's central administration in San Javier. However, last time I was over this appeared to be closed everytime I passed it.

Try www.rodagolf.com for contact details although most seems to revolve around sales, rentals and golf, anything to make more money, not much on aftersales but from what I understand there was someone dealing with Phase 4 snagging.
Always best to call in in person rather than phone or email
I think you will find all Calidona/Roda staff from old building in San javier have moved into the Sales office at the Resort and rentals and services are in one of the portakabins behind

Hello Paul,
I want to inform you that the property is out of guarantee period.
By law the property is cover by a guarantee, from the issued date of building certificate:
1. 1 year visible defects snagging
2. 3 years minor internal defects eg. damp, small cracks in the walls
3. 10 years only structural, eg, problems with the foundations, resistance and stability of the building.
The guarantee was issued in 2007 , and therefore has now expired points No. 1 and 2.
Please contact with your administrator for more info about the insurance.

My insurance company Intasure will not pay out due to POOR workmanship and Roda say i'm out of guarantee with them, SO IN A NUTSHELL I’M OUT OF POCKET!!!!! Typical Insurance companies.

That is an absolutely shockingly poor level of workmanship. The adhesive should completely cover the walls. In fact from my experience for marble tiles even thicker amounts of adhesive should be used due to their weight.

ive had the same problem, im having to reset half the tiles in both bathrooms.
I strongly suggest everyone should test all their bathroom tiles. Just tap them, if you get a hollow sound you have a problem.
A lot cheaper to fix now, rather than wait until they cause damage.
You gotta wonder what the point of intasure is, if thats their response.
Im with them as well, but the local Llyods have given me a cheaper quote via zurich for next year.

I am also due to renew with intersure surley this should be covered how are we to know it is poor workmanship if they are willing to take the money for insurance they should pay up or check the property out before offering insurance. I am not sure who to go with now anyone else had a claim and been happy with the servicel?

Another problem causing problems to a number of owners is leaking shower or bath drains causing damage to apartments below or leaks into garage.
It seems these may be covered by insurance, but be aware, this comment from Resortalia............................
Dear ............
It is not easy to determine the problem but in some cases it happens because owners unscrew the shower drain grid to clean it and if the base has not been properly laid, it does not fix completely again and it requires a professional to break and repair..................................
Re your own insurance, surely it depends if you have both Buildings and Contents cover as Community building insurance covers only the basics of Community property.

We use Liberty Seguros for our insurances, their agent Miguel is really good and nothing is too much trouble for him, we have found that using an agent to act on your behalf is so much better than having to deal with an insurance company direct. Miguel is based in the VicSam office down in the Mercadona walkway in Los Alcazares. Email address is miguel@insuranceagents.es.

I've heard of several stories over the last few months where insurance companies have refused to pay claims.
So I don't think the problem solely lies with Intasure.
Being a born cynic I have come to the conclusion that insurance companies in Spain just don't pay out full stop. Having said that we were burgled at home and the company paid out for the repairs for all the damage and most of the stolen items. They did not pay however for gold jewellery stolen. THIS IS THE NORM IN SPAIN. Costume jewellery is covered but any "good" jewellery you may have isn't. You have to specify it separately.
ALSO A WORD OF WARNING TO PEOPLE WHO RENT OUT THEIR PROPERTY
I you do rent your property out then you ought to have Personal Liability Insurance.
The biggest problem with Liberty Seguros, Zurich and most other Spanish companies is that either the a) can't provide this or b) only supply it to the value of your mortgage (why mortgage has anything to do with it still eludes me !!!!)
Intasure were the only company I could find who provided Personal Liability Insurance - to sum of €5m.
