Hi Celia, our property never had a garage, it was always to be a Linked Detached Villa, I will post a site plan to onto the photos for all to see,  all properties on M1 seem to also be linked detached, they also have the same sq metres 135msq and are 4 beds with the exception of M1 - 10 and M1 - 11 Logic says that yours should be finished before ours, our estimated completion is July 2007 which is why we have to get a move on. You have said yours in September I think you should check this out.

A silly question but have you got a Builders Contract ??  we signed ours in December 2006 I have been told that the builder has not signed his yet, I see you have an NIE and are having problems, we have a worse problem in that we have an NIF which is the original documentation we used 20 years ago to buy our place in Alcossebre and the Palmera Notary is also saying that he will not sign unless we have an NIE, I am told by my Spanish contacts that they serve the same purpose, I think it would be just like asking for another National Insurance Number here, you should really have a small card which is your NIE and it should be accepted, your Notary has no right to withold it, it is yours, I am assuming that you were issued with a card and number, I question if Palmera really know what is going on. 

I am also investigating an alternative Mortgage with  Santander Central Hispanoa 0207 836 5303 we have already have a Spainish Bank Account set up,  if you are interested speak to Alex (yes he is Spanish), I found him very helpfull,  I am having so much trouble getting things organised, really if I could get out of the contract I would !!

Hi Mike,  just to up date. We have now finally managed to get our NIE numbers from our dozy solicitor at long last.  Re the supposed linked garage, according to our contract the garage has an up and over door to the front and a sliding personal door at the rear.  Steve is surprised on the meterage, you said 135 sq m and Steve thought it was only going to be 88 sq m plus terrraces.  Also did you notice if there was any sign of pre installed aircon? only on some of the resales on the earlier phase pre installed aircon is mentioned.  cheers Celia

Hi Celia, I got the measurements from the original site plan which is what I was trying to upload, I have all our original paperwork and if you give me an eMail address I will send a .pdf of it. I noticed yesterday that anything we are reporting is easily picked up on Google. I am getting so frustrated with Palmera and the lack of correct information.  I have been pushing for my contract and guess what, they now say that it will be with Palmera very soon.  Also all this fuss about our NIF and NIE. My Fiscal represntative in Spain has told me officially that the NIF and NIE numbers are viewed the same. Hi all,

just found this forum and glad that I'm not the only one who's been having issues with Palmera and getting information.

We have bought a townhouse on M5 no.10 and are currently being told completion expected July 2007.

We too were hoping to resell as bought for an investment seems like many moons ago.  Salesperson said no problem selling yet here we are!

To add a little to some of the comments already posted, Mortgages, apparently the problem relates to BBVA not accepting a lot of people to subrogate on the builders mortgage.  The response I got from Palmera was that they do not normally deal with BBVA and are sending peoples applications to Banco de Andalucia instead as they work with them regularly.  Of course this means a cancellation fee on the builders original mortgage though!

I am going over to Spain on Monday 21st May to collect my NIE number applied 4-5 weeks ago told it was ready for collection 2 weeks ago!  I will take some more photos to add to recent excellent photos.  I am also going to see the completions department of Palmera whilst there.

If anybody needs some specific information about the properties etc. let me know and I will try my best to get it for you.

Meanwhile hopefully everybody will keep in touch until completed!

Hi all, well things have moved on again. Guess what I can use my NIF instead of NIE as they are the same!!!! That was what I said all along. (Note I have had my NIF for a long time way before the NIE was invented) I have complained bitterly to Palmera about no builders contract and guess what Palmera say that the contract has been signed and they will send as soon as they have it back from the Builder. I say say that as I have no sugned builders contract that we only have a verbal contract and on that basis there is NO contract. Any comments welcome. I am gradually coming to the conclusion that I wish to pull out of this and so am instructing Palmera accordingly.

Hi We are supposed to be buying M4 No.7 as a resale - reservation of 3,000 on 8/11/2006 but nothing further!! Even my solicitor cannot  seem to get any reply.I  have been told that completions are starting from now but thats it! so I dont no if this sale will go through or not   Any thoughts?

You know this is stupid, I am told that I cannot sell as a resale because Palmera say the builder will not allow it. Now who is telling the truth. I had the property up for sale since January 2007 but was told that there was no interest.

I would like to sell  before I have to take out a mortgage, if you are interested then please let me know. Ours is a 4 Bed Linked Detached M2 N7

Well if what you say is correct that explains why I am no further forward with getting the resale-Palmeras keep saying there is a problem with the seller,builder and contracts etc ! I was looking at the smaller townhouses too be honest but please send details  and I will discuss with  OH

hi all

we are new to this forum.

we are also buying in fuenta de piedra M2 plot 13. we are flying to malaga tomorrow, we have an appointment with palmera on wed 23rd may, and also have an appointment with an independant solicitor to go through all the paper work as we are getting worried, it all gone on so long, and in light of recent bad press surrounding palmera.

will be going on site to take some photos will post them on the forum, also let you all know what palmera and solicitor has to say.

keep up the good work its a great forum!

Hi everyone latest with us is that we spoke to Palmeras this morning and still no contract returned from the seller(Mr Walton) but just phone again at the end of the week! This is the way it has been since Dec now and we have been told completion will be May/June but I dont want to set up a mortgage if nothing happens

Hi everyone,

just back from visiting the site and have uploaded some photos.  I have lots more that I will try and put on shortly.

brief description of each photo below

1. (on its own) Picture from my roof terrace M5 No. 10 looking across  to  M1 nos 11-18 in the middle is currently a worksite but informed will be landscaped with grass and trees etc.

2nd block of five photos

1. similar photo taken from 1st floor bedroom

2. Bathroom in townhouse

3. View from roof terrace with M3 no.11 in foreground, M1 in background and across to lagoon

4. View of M2 from ground level outside my property

5. Pool at the end of M4

A couple of things that we noticed while we were there. Back gardens/patios  are practically non existent on the townhouses.  Also if you look at the plans I have a pool out the back of my property, great I thought only problem is the pool is on a higher level than my property and therefore I have no access to a pool that is two yards from my back door!!

More worryingly is that every property has a space for a car to be parked and yet they have not dropped the kerbs in front!!  there are some kerb drops but they would appear to be for wheelchair or pram usage up and down kerbs rather than for vehicles.

Essentially most of the site is finished with the exception of M1.  I will post other photos that I think may be of general interest but if anybody wants to ask me anything let me know.

Hi there, Well I have been to a Spanish Lawyer from my town in Alcossebre, who says that Palmera are very wrong in NOT sending a copy of the Builders contract. My Lawyer has said that he should send a letter stating what has happened, also that he feels that we should be able to sell prior to obtaining a mortgage, I must admit My wife and I are so concerned about all this that we may just walk away. 

Has anybody got any idea's of resale prices ??? we have a 4 Bed Link Detached. I have asked about a mortgage and it will cost my wife and I about €4,000 to set up and approx €600 per month interest only for the first 2 years and then €1,400 per month there after for the next 11 years. This is with Santander and as I have said befofre this can be arranged if necessary in three weeks via London.  I really do not want to take out a mortgage.

The other interesting point was I understand that Palmera Lawyers have changed two years ago. The Lawyers acting on our behalf with Fuente de Piedra are Gomez de la Cruz & Puertas, C/Maestranza 12-12 - A 29016 Malaga Spain, 0034 952 219 871 karen@gomezdelacruzypuertas.com

Hi everyone,

just find this site after looking for a lawyer in Spain. i am going to use a G.V.A agobodas, based in malaga,

i have just about had enough of plamera and there lies. i brought a off plan townhouse. N04 on M4. four years ago, but sold it last Nov.

i finally had a cheque for the first instalment off palmera last month 25000 euros, and quess what, it has bounced.

after reading some of the other postings on this site, i am not the only one sick with worry.

i am sueing palmera for loss of funds, compensation etc etc.

what i am worried about is that i beed to sign a cancellation contract, so the new buyers what get taxed, then the builder will send me the full 44000 euros.             just dosn't sound right , does it? so, a lawyer is costing me 2000 euros, buit can i trust him?

Well it's been almost 2 weeks since I sent a letter that said I was cancelling the contract, that I still havn't got a copy of. After seeing so much of this thread I am beginning to think that my route may go legal.

Come on everybody on Fuente de Piedra all phases should we get together and sort this mess out? anyone interested. Perhaps we should hire the services of a spanish speaking lawyer to act on all our behalf. I feel the danger maybe that we could make such a fuss that Palmera could go out of business but hey who cares !!!!! what matters is us getting at least a fair percentage of our money back or satisfaction. My feelings are that we should use a spanish speaking lawyer and speak directly to the builders Fonslapis.s.l. and see what is going on.

Has anybody got a copy of their builders contract ????

On another point, I am just waiting to see the documetary on the spainish property price crash tonight on ITV with Tervor Mcdonald.

Hi,

the lawyer that i will be using, tells me that he got another client money back only last week,.

he speaks directly to the buildier and not palmera, as they can not be trusted

i am up for a mass sueing legal on palmera
