I own a penthouse apartmrnt on phase two, the wall has a crack that requires repairing does anyone know what the best method is to do this. Once i have repaired the wall it will require re painting are there rules regarding what i must use and the colour of the paint.

Hiya

If you are on one of the black cks that have recently been repaired or redecorated, this should have been taken care of.

If so you should contact Resortalia to check out if any insurance claim could be made.

If your block has not been repainted it is because we were advised to issue a legal claim against Roda for defects in the original build causing cracks etc.

It is possible this could be included in any claim but will take done time as we are reliant on the Soanish Legal system.

In all events, Resortalia as P12 Administrator can advise you of any rules, regulations, materials, paints etc. You may need help with.

Hello Hugh,

Thanks for your reply, i dont know what has been done to the apartment as we have only just prchased it. I have already sent an e mail to Resortalia to ask them about the crack. We are in block 50 phase two is this block one that is covered by the legal claim. What does the legal claim actually mean are Roda being sued for reperation work to be carried out.

Hi Hugh,

im in block on phase 3 and have the same issue with a crack, do you know how I find out if we are scheduled in for repair? The crack looks worst just under the solarium, do all the blocks have this issue?

Hi Spangled

You really need to contact your President and Resortalia for information.

P21 have recently won a court case against the developer and are due to receive compensation and presumably will carry out repairs if it is communal.

P20 are waiting to issue a claim and will delay repairs etc. Until a satisfactory outcome.

thanks for getting back to me so quickly! Did you mention repairs have already started on some of the blocks? Are they phase 2 blocks? I did get an email from Resortalia back in 2014 saying that it's cosmetic damage but would be repaired. Has the reason for delay on this and other blocks been down to doing this through compensation rather than community money.

As I said, all your questions and concerns can be answered by your Community President and/or Administrator and would have been discussed at your Community AGM.

I was able to answer the original poster as it concerned P12 on which, repainting and redecoration of a number of blocks had commenced prior to us being informed about a potential legal claim against the promoter.

Sadly, on Roda all the various Communities, large and small are run independently, each by a President or Committee elected at an AGM. There is no official forum to discuss or swap information.

Any work, legal claims or business undertaken by other other Communities would only be speculation on my part other than a few bare facts I have already answered.

I am sure a phone call or email would provide you with the answers relative to your own Community.
