Appeal Court of Murcia confirmed th responsability of Banco Popular to pay the money back for the purchasers at ACC

Again, we want to give some good news , as Banco Popular has accepted and has not filed an appeal against the recent judgment of the Provincial Court of Murcia, number 163/2016, where the appeal court has confirmed the court decision granted in favor of several clients who presented a joint action represented by our firm.

But also the same Bank, in another recent judgment won by ourselves in favor of a British couple, has not filed an appeal to the Provincial Court of Murcia, accepting the judgment granted in April 2016 by the Court No. 4 of Totana, which is a change in the bank litigation strategy, since before systematically they appealed all court decisions.

Similarly, the other banks ( CAM bank now SABADELL) that opened some bank accounts for Huma Mediterraneo and received some payment on account from the buyers, in some cases, are accepting responsibility before the courts, even before the court decision is granted, acquiescing to the claims presented by us.

That's brilliant news. Thank you for sharing.  Our case was heard in Totana in April (also against BP) so let's hope for some news soon.

Hi Thats great news at last there is justice.We have our court date in Sepember with yourselvs, although it seems along way off at least we have a date and hopefully will have something to look forward to very soon.

How long roughly is it taking to get our money returned from the banks after the court date ?

Our case was heard on 31st in May in Totana against Banco Popular. Our solicitor has told us to expect to wait for around 4-5 months for the final outcome. Of course, we have everything crossed!!

Were you in court on same day? Unfortunately there's no news to report other than an e-mail today from our solicitor just saying that the Spanish legal system is slow and that we have to be patient!!! As if we didn't know!! He did expect to hear something within about 5 months but that has now passed  so we still live in hope that one day we might get some good news.

We won our case in February and just received the money into my bank account today.  on that basis it's about 8 to 9 months to get your money back.  There was no warning we just had an email Monday asking for our bank details as they had our money back from the bank.  We were also with banco popular.

Is that your case totally finsihed now or are you waiting for costs & interest?

The court didn't award us costs - neither side were awarded costs.  I think this was because when we started our case the supreme Court case hadn't been heard so the court felt the bank were in their right to defend the action. Hopefully we will sometime get interest.

To be honest I feel quite lucky as if Huma had all the correct licences I would have ended up with a property worth half or less of what I paid for so to come out just loosing a thousand pounds or so is a real positive to me. 

Although I can appreciate your great relief, please don't underestimate the stress, the abusive banking malpractice, the length of time to achieve justice which has compromised all too many of those who have had to put their lives on hold for over a decade, having been stripped of their life savings or ability to take pleasure from their original intent to own a home in Spain in the interim lengthy periods. I sincerely hope the banks are made fully compliant and accountable for this decade, during which they have been frequently obstructive and dismissive of their legal obligations to adhere to existing law, already in place to protect offplan purchasers.

We received our money just over a year ago, full amount less costs which was quite a lot. We were awarded costs and interest but we are still awaiting the court to decide how much we are owed. At the minute we are still 21,000 Euros down
