Quick Question  - having lots of problems getting the bank guarantee from the builder.  This was supposed to be given to my solicitor in early January and she and I keep getting the runaround from the real estate agent and the builders office.  Any solutions to this????????

We are having the same problem, been asking forours since we signed the contract in March 2006!!! our solicitor said that it would be with them 2 wks ago but still waiting. Don't know if anyones got one? I think if you are really deperate you can threaten legal action on both builder and soloicitor. The builder for not complying with the  1968 New Proerties Act, and the solicitor for derelict of duties for not protecting your interests.  We changed from the builders lawyers to an independant one in the hope that things would be done more efficiently and less biased. As yet that has not worked.

Do you know, for a fact, that your builder IS giving you a BG as some don't even though it is mandatory for newbuild/off plans (to protect your stage payments)

Our builder CHARGED for giving us a BG, which is illegal but he did it, nevertheless. As our agent had told us on our inspection trip ( but not till we insisted on knowing, mind you ) builders HAD to nowadays give a BG, we were totally horrified to learn that, once we'd signed, they charged (depending on time we needed the insurance, as that in effect is what the BG is) & ,after a lengthy argument with the agent, the agent agreed to pay it as he had inferred it was free & we were entitled to a BG.

We had the BG in force from Sept 2003 (date we signed) till April 2005 (completion date) & the builder charged the agent 1248€ ( I have the paperwork here in a massive box under the bed )

I have just had a response back from my solicitor.  The builders have advised them the Bank Guarantee is still with the bank and they are still awaiting their copy.

They will continue to chase and when I know more, I will update you.

Karen and I are to meet with the developers next Wed and they have promised to hand over the BGs. I will keep ye informed but I think that it is looking good !!!

Firstly, Thanks so much for your photos. I was about to load mine when I saw yours. I put my camera away in shame. Your photos were brilliant !!!!!!!!!!!!!!

And yes, when did get our bank guarantee (a copy). An original was suppose to be sent to our solicitors but we havent heard anything yet. I also noticed a difference of over €200 from what I sent and what they are saying they received. I must also check into that.

Otherwise very please with the actual building and the location I think is ideal.

I'd say that it will be Sept/Oct 08 before they are finished !!!

What makes you think the competion date has moved from May 08 to Sept/Oct 08?  When I was out there I spoke to the chap in the Golf Invest office, he said that although they had fallen behind a little bit (due to high winds), there was no change to the anticipated completion date of May 08.

I was actually amazed at the changes that occured with the floor going in on phase two on the one side then the pillars going in for the next level for the other side.  It appears to moving quite quickly!   

Hoping we will be there for next summer !!!!

Just had a thought about the €200, I remember reading somewhere, where builders try to charge for the BG even though they are not supposed to, so it could be that!!!!!

In my contract which I was issued in November it states May 08, so I wonder why there are different dates?

On my contract (Oct 06) it also stated May 08  but when I gat a copy of the bank guarantee it had this line

"Este aval tendra validez hasta el 01 de Octubre de 2008 "

I dont know what that means but the date stuck in my mind !!!

Hi Guys,

My solicitor has just confirmed they are also now in possession of the the bank guarantee and will forward it by post.  They have confirmed the BG expires on 1 October 2008.  Basically they have built in a couple of months from the May deadline !!!
