hi everybody

i have just discovered this forum whilst trying to get information on the development.  I haven't had a chance to read all the messages posted but i will............

just to give you some background I paid 50000 euros down payment almost 2 years and the whole thing has been a nightmare starting with my estate agent JEANINE GOODWIN blatently ripping me off to finding out by accident that i had to go through with the sale.........its a long story and one which i will tell if anybody is interested but on a more positive note I would like to assure you all that i visited the site a few weeks ago and it looks great (apart from the statue army which seems to grow each time i visit!!)n and I was told recently by an agent that you can expect anything from 240,000 euros plus for a two bed when the development has been completed. Also expected completion should be the end may/early june.  Hope this is good news for all of you reading this!

I am now in the process of trying to find the best mortgage deal available by a spanish bank, any suggestions or indeed names of reputable brokers would be greatly appreciated.

Hi Molly Sorry we're only getting back to you now, I have seen your reply to our recent request. I would be interested in comparing notes and I will get back to you via e mail as soon as we have some other news. We have just been informed that completion now looks set for September/October. Just wondering if you have heard any information to confirm this? Hope to speak to you soon

Hi Irish Buyer

Who did you hear from to say completion in Sept/Oct, we have just returned from Spain and were told that the developers say the end of May but our Lawyer said it is more likely to be June.  On visiting the site they were just putting furniture in and only had the front car park to do.  They were also connecting all the cables to the electric boxes.

hey there

i was on site 2 days ago and they were filling the pool, i am guessing we should all be notified any day soon, I am in the process of organising a spanish mortgage, Banco de Andulsia seems to be offering the best deal so far......

Does anybody know where owners stand with regards to renting out the apartments??

Hello to everybody.

I would like to inform about some things, that can clear up the situation:

- Some people bought the property to Ocean States, or other (I don´t know), and some people, like me, bought the property directly to the Developer: "Bluestorm, Next Xentury, or whatever...

- Bluestorm, Next Century, etc... presumably had problems with Spanish Justice, money laundering,
city-planning corruption, etc. and a Judge from Malaga, designed another company to work as "Developer".
I don´t know when some of you say "Developer" who is it, but  ALL OF THEM HAVE TO ASK TO THE COMPNAY THAT THE JUDGE SETTLED TO MANAGE THE SITUATION. This is true. All the rest are conjectures.

- This company has said: THE CONSTRUCTION WORKS HAVE BEEN COMPLETED, AND NOW THEY ARE BEGINIG TO SOLVE ALL THE LEGAL PERMITS WITH THE TOWN HALL OF "LA LINEA", WHERE IS SITUATED THE PROPERTIES. THEY HAVE TO APPLY FOR SOME "PAPERS", HABITABILITY PERMISSION, END OF WORK PERMISSION, ETC. THEY DON´T KNOW WHEN IS THE EXACT DATE FOR THE TRANSMISSION TO THE OWNERS, BECAUSE NOW IT IS TIME FOR THE LOCAL ADMINISTRATION. IT COULD BE BY JUNE, BY SEPTEMBER, ETC, THEY DON´T KNOW.

- I have been in the complex and IT IS TRUE THAT ALMOST EVERYTHING IS FINISHED, EVEN THE RECEPTION, THEY ARE
PLANTING PALMS, FILLING UP THE POOLS ETC. Almost everything that can be watched from outside is finished. I don´t know how is inside the apartments because they don´t let me going into them.

- On May, 27 there are,in All Spain, votations to choose mayors in town houses, SO NOW ALL THE LEGAL PERMITS AND LEGAL ISSUES ARE GOING TO BE SLOWER. That´s why they don´t know when is the completion date, and transmission to the owners.

- Legaly, the apartments are not  "for living in them", they are for renting. Have you ever seen a flat or a house with reception?
I don´t know exactly the law but, we should provide them for renting a minimun time every year, maybe one month, I don´t know.
Anyway this is not the first apartment in Spain of this kind.... It can be solved to live in it.

- For those who want to rent the apartment, (like probably me), we cannot rent it by ourselves. A renting company, selected by the "actual developed settled by the judge", will manage the renting of all the apartment, and of course, a percentage of the money will be for them.

- This complex is constructed in a land which is not allowed to built houses (for living), so they decided to apply for building a "touristic apartments", which are allowed in this kind of
city-planning lands. In Madrid there are many problems with this, because they can built apartments where they cannot built houses, and even at a lower price (apartment furnished with pools paddle court, gym, etc for that price).

- The Spanish Law for this kind of apartments say that the first day that you get the apartment, you can rent it, THAT´S WHY THEY SELL THE APARTMENTS WITH ALL THE FURNITURE, THE TERRACE CHAIR AND TABLES, AND EVEN THE GLASSES, AND PLATES. THIS IS NOT A PRESENT FOR US IT´S SIMPLY THE LAW REQUIREMENTS.


I don´t want to give extra work to lawers or "developers", because maybe some of you have now many doubts, or maybe all of you know all these things. BUT I THINK THAT EVERYBODY SHOULD KNOW THE TRUTH, THEY SHOULD KNOW THESE THINGS BECAUSE WE HAVE INVESTED "A LOT OF" MONEY. If you don´t know all these legal issues, maybe you have been deceived or maybe they didn`t tell you all the truth. I have also been deceived in some things.

Another thing is that I am glad to have a cool San miguel or other beer, and also some fried fish with somebody who comes to the area. Just send a message and let me know when you come. Remember that I know many places here, I am the SPANISH buyer. also I request pardon if any word or any sentence is not correct due to my english, which is not my mother tonge.

There are a lot of apartments like this in Madrid. (TOURISTIC APARTMENTS).

 I have read in another forums (in spanish), that a lot of people have been deceived with these apartments. High quality construction, pools, paddle courts, gym, gardens, etc for nearly the half or a third part of the normal price for a house. So a lot of young people decided to buy them. Their surprise came when they knew that it is a "touristic apartment".

They were deceived in the way that these apartments are not "for living in them". It is supposed that you have it for renting.

Of course many people went to ask for advice to a lawer.
These lawers or even the same developers who sold them the apartments said to them:

Ok, you can arrange with a company who works with rentings, that, for one month a year, you make a "fictious contract" for renting it to somebody, BUT YOU LIVE IN IT. Some owners asked: ¿what hapens if an inspector comes to check it?, and they said: There is not enough inspectors to check all the apartments. For the good and for the bad, this is spain.

But also, I have read that in Madrid (only in Madrid at the moment), the owners of these apartments have to become a "renting company" (because they bought a touristic apartment). Goverment made this because of the abuse. They said ¿what is the interest of a tourist apartment far away from the city, near a industrial estate, or near the airport?. The solution is that Developers "invented this way of construction, for selling later of course". Remember that these areas are not  predicted to built houses (for living in it). You can only buitl a hotel a Carrefour, a Lidl, a Decathlon, etc.......or a Touristic apartment. That is in spanish "suelo terciario". It is not "Suelo urbanizable" where it can be built houses. (You can tell your lawers to explain it better than me).

it is now a long time that I do not read these forums and I don´t know what happened and how it ended.

Sorry that I do not post new pictures of the complex, but it is nearly the same: it is all finished outside, I don´t know inside.

But for those who know the place, I have seen a lot of excavators and trucks working and cleaning the field towards the Tower, that means that they are going to built more complexes or hotels (wich are predicted for the area). Our complex is the first one, and it is "the gate" for the others. I think that´s good for ous.
