As manzana 4 owner, I really don't feel I have to make public our policies and decisions regarding our community.

Why not try and strike up a personal relationship with one of the residents next time you are out there and they (or indeed I) might reveal why we have done what we have, and maybe explain why I for one am delighted in the way things are being run as opposed to the first two years of our community life.

There is no mystery, underhand dealings in play. We are just enjoying the fruits of a well run community.

Interesting that you say people are completing every week.  I have had a telephone call from someone today telling me that her lawyer has told her NOT TO COMPLETE!  Apparently they seem to have thrown good money after bad.  She also said that this whole awful saga has put a strain on her family life and marriage and has been on going over the last three years!  I too know how it feels when we all thought we had the appropriate licences, planning etc. only to be told it didn't exist.  I too know of banks refusing to issue mortgages.

As for Manzana 4 it is a nice community and things have most certainly improved since the new president took over and lets hope it continues to do so.  We all want a community to be proud of.  Also why is everbody suddenly interested in what Manzana 4 does?

I agree with bcstrachan there is no mystery or underhand dealings in play.  All those things happened in the first two years of ourcommunity life!

This is much better - thank you and I am very pleased that you are happy with life on La Reserva de Marbella.  I am very happy that you and many others have completed and are enjoying your apartments as I and many others do also.

I was concerned about the filled-in swimming pool as posted by james 123 and reports of spiralling community fees I received by private message.  The high-level secrecy and lack of any helpful information from your president only fuelled the flames of suspicion, so I appreciate your messages on here which seem to be honest and open.

Regarding people completing, I do not post anything misleading.  People are completing very regularly and whilst there are banks who refuse mortgage applications, the refusals are NOT specific only to our development and there are very definitely at least 5 banks in Marbella willing to grant subject to status.  As posted I visited the banks personally.

The licences are shortly to be issued in full and all of this hideous mess will be resolved once and for all.  I look forward to the day when we are all equally positive and are enjoying the whole development as it was originally intended to be.

Thank you again for your positive posts.  Please post more of them again soon as you appear to have a lot of positive feedback which is a true reflection of the community and this forum would benefit from that information being shared.

That would be good if we get issued with our licenses.  But I will only believe it when I see it  so fingers crossed and lets all hope that things can only get better.  Our Manza has certainly got better in the last two years despite these problems and underhand dealings.

One of my apartments overlooks the pool in Manzana 4.  Now that the childrens pool has been filled with soil and plants there, I am really very concerned that the only pool that babies, toddlers and children have to swim or play in is the adult pool at a minimum depth of (I imagine) the standard 1.3metres. 

Please resist responding to such an important observation by saying it´s none of my business, as I am certain that babies, toddlers´ and childrens´ safety is of paramount importance to all adults of sane mind.  A drowning through negligence would be dreadful anywhere, not just on our development.

Furthermore, I have received a message from a Manzana 4 owner who purports to have no knowledge of any vote that is said to have been made to take the decision of pool filling.  Can the minutes of the meeting in which the vote was taken be supplied so as to clarify this matter a little further?

The vote re the swimming pool  was taken at our last AGM.  I was at the meeting and the owner in Manzana 4 would have obviously given a proxy vote or attended the meeting.  If they didn't do either then they should take more interest in THEIR COMMUNITY.    We were sent a form of options about the pool after the meeting and asked to vote how we wanted to address the situation. If they are an owner then they will have a copy of the minutes.  Why should we show minutes to concerend people like you as it is the owners of our Manzana 4 business and not everyone elses.  If you take a further look we have erected a fence around the people with gates and locks to ensure child safety and no children, babies toddlers should use this pool without adult supervision. That should have been the case with the original child pool.  That surely is common sense to most people with children.  I would also like to point out that the shallow end is only ankle deep much shallower than the original child pool.  Hope that puts everyones mind at rest !  I think it is a shame that we can't all work together to make the whole complex a great place to invest and live instead of all the backbiting and sniping that goes on and certain people linked to the developer always interfereing.

Lots hope one day this awful mess the developer has left us with  will be resolved and we can all live peacfully without all the uncertainty.  At the end of the day it was the greed of the developer that has got us all in to the awful mess we are in.  No licence, shoddy work, being ripped off from day one over various matters too many to list here!  We have in our Manzana spent al ot of time and effort and money putting right many of the wrongs left by the developer.

Fingers crossed we will get the licence and lets hope we can all live in peace and not the nightmare many of us are living in now.

Thanks scottiedog for your reply.  I am not an owner in Manzana 4, although I am in regular contact with at least one owner there through this site who feels they are unable to voice their concerns for a number of different reasons.

Firstly, it is all OUR COMMUNITY.  You may want to think that your Manzana has broken away, but it can by law be no more independent than any other Manzana already is and all Manzanas work to make up all OUR community that is La Reserva de Marbella Fase II.

Secondly, living with the fact that a licence is about to be granted for the development is a whole lot easier than living with the nightmare of a child drowning in the not-so-shallow deep-end of the adult pool.  I find your attempt to deflect concern from child safety to an almost foregone conclusion that is the LFO in 3 paragraphs quite sickening.

Thirdly, the minutes of the AGM that I have seen make no reference to any vote or agreement to fill in the childrens pool.  You also appear to be relying on the legality of a vote by ´a form of options´ (Handwritten?) on a piece of paper with no minutes taken at a time after the AGM.  I am not a legal expert, but it is clear to me, that this is most certainly not the legal way in which to deal with such an important matter that affects the whole development, not just Manzana 4.  Reading your apathetic and naive approach to such an obviously illegal situation leaves greater concerns; much greater. 

Fourthly, I am all for working ´together to make the whole complex a great place to invest and live´ so too the majority of owners (especially on this forum, it now appears).  Ideally, I´d also like to see all our pools as safe swimming pools not flowerbeds and some greater transparency in the secretive and most likely legally incorrect happenings in Manzana 4.

Finally, I am not going to repeat any more than this one final time, the fact that I do NOT work for Peñarroya, Junta de Andalucia (planning office, tourist office or otherwise) or Ayuntimiento de Marbella.  Nor am I bothering with other points that you keep moaning about regarding craftsmanship, design, the past etc on this thread.  These are all things that the majority of owners and new buyers are most impressed with and can see the real situation of.  Please at least start a new thread to debate this, as this one is titled ´Manzana 4 swimming pool´ in big red letters.   Or you could move off the development totally, if you´re that unhappy.

I look forward to any further information from the people in Manzana 4.  Please note, I have to travel away again this evening and so will be unable to read responses to this (if any) until at least tomorrow evening, leaving plenty of time to find unaccounted (handwritten) questionnaires that prove my initial concerns even further.

Oh so you have a copy of the minutes?  You asked for a copy on your previous posting.  No it wasn't a hand written note it was by email and post.  The pool issue was discussed at the AGM.

I did not say you worked for Pennaroya if you read my reply.

We in Manzana 4 were one of the first phases to complete on the complex and have problems from day one.  What do you know about this?

We are putting safety first,  but as you are not an owner in Manzana 4 you obviously don't know the reasons why we have done such changes. 

May I ask how you know that licences will be granted ?  Perhaps you know our ex Presidente very well and certain family members.

Boy, Boys Boys, don't fall out!

 All residents in Manzana 4 were given the opportunity to weigh up the pros and cons re our pools. As far as the majority of residents are concerned in the community the issue has been resolved in line with the vote based on the options that were available. I'm sorry if you are unwilling to accept that.

You do make me laugh, going on about it. You must come round for a glass of wine sometime, and we can have a mutually fulfilling chit chat. I'm sure you'd love to hear of our positive community experience first hand.  

If you want something to moan about what about the huge security bill being charged to the master community - now that is scarey. I'd love you to get behind that cause - how much is it per year? Over 250000 euro?

Well done bcstrachan.    I am not falling out with anyone but just wish other people would stop going on about what we do in Manzana 4.  Perhaps they should just worry about their own Manzanas. I agree with you and I whole heartedly agree that we are a positive community in Manzana 4.

Dear kennye

Just a quick comment, are you aware that 95% of infant fatalities occure in infant pools in spain and not in main pools, Oh and by the way our pool is now fully fenced at a cost to Manzana 4 owners and the shallow end of our main pool is shallower than the filled in infant pool.

This information is factual and is of common knowlage to all M4 owners. See Ya Kenny
