i have spoken to duquesa estates and he may ask every owner for 100 euro to get the pools done, personally i think the agents should use there 10% commision off each property i.e 15000 euro x how ever many they sold!!!! and they build the pools as we have already paid for them, please post your views on this matter as i think the piss is being taken out of us, if you brought a car and it arrived without seats what would you do!!!, the only people who have made money off this farse are BMS Homes, Duquesa Estates, whatever other agents are involved and AIFOS DOGS!!!!

While I  agree this whole project including delays to swimming pools and other facilities is a catastrophe I am taking the approach that when AIFOS eventualy offer me final ownership of my apartment I shall refuse to complete the contract until all ancillary items such as the pools, tennis courts, putting green etc are in place. If every individual prospective buyer took the same approach I bet it would not be too much longher for the project to be completed in total .The only way to make AIFOS sit up  and take notice is to apply financial sanctions.

I would say at this point however that the swimming pool  delay/cancellation is still not definitive. We need someone to go to site and take pictures so we really can see how the land lies!

I have just e-mailed our agent Garu asking for some clarification on this situation.  We are coming out to Spain at the end of October to see what is going on and how the complex is looking.  We haven't decided whether to keep our apartment but I can't see us selling easily if the complex isn't going to be completed re: pools etc.

When I hear from my agent I will let you know of any news.

Anyone else out there with any news?  We have bought since July 2003 and our patience has worn thin now!!!

 

 

We are going out at the begining of Oct and will get photos and talk to the lawyers. One comment which is relevant I believe, is that we should attack the situation as a community because it will be noticed?

Surely any legal challenge will only succeed on the clarity of the contract and what it states regarding recreational facilities?

If you have spoken to Duquesa Estates and wanted to comment here on a public forum you should have put my comments across correctly and not twist them they way you have.

The following was an email response to Ken Gleeson’s question of swimming pools sent before your posting and is the very same response you would have received over the phone.

 

With regard to the swimming pools or lack of them this is firstly down
to Aifos to provide what was in the original plans however even if they
do provide these swimming pools at some stage in the future we can now
see that the majority of apartments will be a good walk away from the
location that these swimming pools will be built if and when this
happens.

Like you I have bought an apartment at this development which I intend
to keep and I can see that with the amount of properties on the site 2
swimming pools will be inadequate.

What I have suggested to some other purchasers is that at the first
community meeting I will put forward the idea that we look at the
feasibility and cost of building a swimming pool where Nardo, Petunia
and Fresia were going to be built, because this land will now belong to
us  the community it would make common sense that between the number of
properties involved the cost to build a swimming would be minimum and
the advantages of having a pool in the middle of the development would
benefit all owners and increase the value of all the properties.

This would need to be voted on at the first meeting and could only go
ahead if the majority were in favour.

I hope the above all makes sense.

 

As you can see this is not intended in any way to make any one pay extra for something that should be done by the builder and your comments are completely out of context.

With regards you comments on commission, do you think Aifos treat agents any better than customer…?

I have been working for nothing on this development for the last 2 years taking people to the development on a daily basis regardless of whom they bought from, many agents who sold for Aifos have since gone broke and in a many cases directly  because they were not paid by the developers that they had sold properties for.

For the last 3 years we have been the only source of information/ photos or access to the building site for hundreds of purchasers on this development, we do this because it is the right thing to do in the situation, it’s not the customers fault that we are not paid.

 

If we can help anyone we have always done so but your ignorance has really rattled my cage.

I have no problem with paying whatever for the swimming pools to get them done, i was simply stating that i think it is a michael take if we do have to and agents will have made good money on completion and should maybe chuck into the pot as the purchasers are not going to see any profit in the near future.  i think the pool problem will need sorting out sooner rather than later though as if i was a family with children i would not consider renting on a complex in the summer months with no kind of pool, more to the point i would never have considered buying in the first place but thats aifos for you!!,  with the amount of apartments on there i think we should consider throwing in enough to provide a few good size pools to accomodate the people who will be using the complex when it is established, as i see problems with people saying the pool is closer to some than others so a few dotted about would be better, if aifos drag there heels we should get the pools done asap and then fight to get the money back in due course rather than hanging around in the hope they may be done one day.

after all this maybe aifos will complete the pools !!  NOT LIKELY!!

Hi.  Does anybody know where exactly the swimming pools were planned to be located and has anyone any idea when the first blocks are to be handed over. I have bought in lirio 4 years ago and I am getting very nervous about everything i am hearing lately.

 

Just a quick comment on Duquesa. We did not buy through them, however when I first looked at their website a couple of years back, they offered to help any other "non customers" with enquiries. Since that time we have made many phone calls,sent lots of e mails and all have been responded to immediately and have proved very helpful.

As I said in my previous posting, it is important that we fight this as a community and not as individuals.

I believe the swimming pools will be located on the left hand side when you pass the last small roundabout at the top end of the site (past the football pitch area).  There is definately a large amount of waste land there, and when I went up to see my apartment 2 weeks ago, there were diggers and activity in that area, I know that doesn't mean too much, but lets hope they are flattening the ground to accommodate the swimming pools.

i got an email from aifos asking me to get in touch to set a date to snag my appartment ,just wondering have they got in touch with the rest of you , shoudn;t be long till  we move in and  hopefully the pools are sorted

was on the site a couple of weeks back was in the same apartment as the guys from duquesa estates took a few photos which i need to download if in get chance i will post them this week. i hope the swimming pools get built along with the other promised stuff if not i think we should hold the cash back   

HI - things seem to have gone quiet with no messages posted.  We are going out for a few days at the end of October and are going to 'snag' our apartment.  Will let everyone know what we think when we get back.  Have been contacted by Aifos to choose parking space - anyone else had any contact from Aifos?

 

 

I went on Friday 5th and must say that I think the site has months of work to be done before I will be acceptable to any sign off?

There was no activity on site at all and the blocks I looked at were in very poor condition in the communal areas. By this I mean concrete splatter all over the stairs and walls, broken tiles, damage to rendering, dirt and dust all over the place etc etc

I have a few, so so photo's, but I will post them anyway, when I get a chance.

Oh and returning to the title of this thread - I didn't see any action on pools being built?
