           Hi I paid 30% deposit to purchase a holiday home on this development which was to

            be completed Dec 2005 but to date according to my solicitor they still have not obtained a

           first occupancy licence. We are now tangled in a legal battle in court as I am trying to get

           my money back but that’s  a big joke in Spain.

           Unfortunately corruption gets the better of most people and I fear that unless I

           Have the backing of other people in the same position I will end up loosing my

           life savings and the property fighting this case.

           If I could go back 3/4 years I would never have put my money into any property in Spain.

          So If you are in the same position You can help me by letting me know that I can have your

          support and hopeful if we can form a large group the Spanish courts will have to take note of

          what is right and not what is corruption.

Santa Maria Village (SML) is a first class development and those who bought to use and who have completed are enjoying one of the best developments in a fantastic area with great local facilities a short drive away.

The fact that there are banks lending on the property , lawyers supporting completions and the utilities fully connected and working will underline that this is not a property with any inherent legal problems. This development like many others got caught in the the administrative fog of the Marbella corruption scandal.

The Developer has been fully transparent as regards the minor issues that there are and has recently discussed the case with the new Mayor's office and is reassured that the actual granting of the paper licence is now within reach. For those who have done their research will know that everything has been done to comply with the granting by administrative silence which has been sufficient for years past.

If you happen to be one who has put their deposit down in the hope that you'll earn a profit in the short term you will be disappointed. if you are not then just take a pragmatic view and enjoy the development as we have and put aside your fears - SML is not and never has been a troubled property. Join those of us who have enjoyed a year or mor eof a beautiful development.

With respect ,no one forced you to buy and the developments in this valley are excellent and unlike other areas will stand the test of time.

Did you buy it for yourself or did you buy to resell at a profit ?If you bought it for yourself then whats the problem? If you bought it to make a short term gain then thats tough I am afraid.

You have what was contracted to buy and unfortunately the L.F.O issue has raised its head involving thousands of properties.and will get sorted in time.

I suggest you save your money going after the developer when its the system at fault and no point in slagging off just one development.

Suggest you listen to this and patrics post and wish you well in your eventual outcome

There are threads that you can join in your quest for justice and get some very helpful advice as well. ( DETAILS OF WHICH I SENT TO YOU)

I bought this property as a holiday home, however whether as a holiday home or a resale this is no reason why one should

complete without all the appropriate documents, I am been told not to complete without the L.F.O.

If the developer is not at fault then way does he not go after the Marbella council for compensation?

rather than trying to come after the purchasers for interest to be added on the sale price,is this justice,

shortly this is going to get every ones backup even more and it will be unlikely  anyone will complete.

I agree with you Santa Maria Village (SML) is a first class development,

However all the bank are not willing to give money for mortgages without the F.O.L only the developers bank will.

Lawyers supporting completions????

I have been to see 4 Lawyers in the area they all tell me the same thing DO NOT COMMPLIT WITH OUT THE F.O.L.

If the granting of the paper licence is now within reach. then why is the Developer try to add interest on our sales price

is it our fault the  F.O.L was not issued.

Why does the Developer not take the Marballe council to court for compensation, or is there more to it !!! and other things might

 came out in the open.

I agree 100% that the Marbella council should be responsible as rightly everyone gave their trust in the system they allowed to become corrupt.

How the developers can now try to get interest of of the owners is beyond comprehension however trying this action may be much more difficult than they think.

Think and hope that this is more of a scare tactic as if this became the norm in Spain it may very well bring the whole market into further termoil

If you want my honest opinion I feel that everyone should have the option of having their money back if shown that either corruption or developers failed to hold to promisis and terms of contract however as we know this will never happen.

I do hope that everything works well for you and trust you may appreciate that you are much more fortunate than many in as much as you have a property that will prove the test of time unlike many other developments on the Costa should you complete.
