As time is moving on, those who wish to take action to reclaim deposits etc need to start taking steps soon, if we wish to do this as a group action through one lawyer then we need to have a private forum or work through private e-mail - or as previously suggested a meeting somewere central. My work takes me over-seas on frequent travel so I cannot put myself forward to be the focal point, but will happily assist who ever is - if there is a meeting my wife will attend on our behalf.
All comments and suggestions welcome - my only other comment is that we have to be careful who is on the forum as I am sure there will be a plant so as to see what we are upto!
Those who have been on the forum for a while please drop me a private message and we can continue through private e-mailing.

Hi All
I`m very interested in joining the group that is trying to get their deposits back due to the likely 6-month+ delay in building completion, if it`s not too late that is. Could anyone give me details about how, if possible I may be included in this action? Thanks.

I have just received an update on the progress of the development. Completion of construction is not until 31/12/2008 and completion of the purchase will not take place until after March 2009 !!!!
We have changed solicitors and have notified the developer of our new legal representatives who are now in the process of trying to get a refund of our deposit.
Is anyone else trying for a refund as I would be intrested to know how it is going.

I instructed my solicitors last month to contact the developers informing them that I wanted my full deposits back , my solicitor gave them 10 days in which to reply.
The developers eventually did reply but are trying desperately to wriggle out of refunding my deposits, my solicitors have sent them a second and final letter, if I don't get any satisfaction I will them have to take them to court to get my deposits back.
My solicitor says this could be a drawn out affair (being Spanish this doesn't surprise me one bit) I will continue to keep in contact with the website to let all know what is happening.

Like most others we have initiated the recovery of deposits but are not holding our breath.
It is my view that we will be lucky to see our money before the developer completes and resells the properties.

Our Lawyers are issuing the formal litigation today to the Procurator of Tribunals to fix a date for the courts...... no doubt will take some time - but hopefully we all will receive our deposits back !!!! good luck to all

We issued instructions to our solicitor several weeks ago now that we wished to cancel our contract to purchase at los Balcones Del Valle, they have so far not even bothered to respond.
I am now extremely worried that the state of the Spanish Housinmg market may dictate whether any of us recieve our deposits back at all.
Developers are going bust at an alarming rate in Spain at the moment.
Recent news in the Uk that the big boys, Bovis, Wimpey etc are shedding thousands of jobs should bring this home to us. The UK market is still relatively unscathed. But....in Spain the market is simply collapsing.
I do not wish to be alarmist, but good luck to all of you trying to recover you hard earned. Just remember, teh developer is not going to simply hand back everybody's cash without a fight.
If he goes bust , well......I don't even want to think about that scenario!

I livein Dream Hills 2 and have been out there for the last 3 weeks which is just along from your development and I can tell you construction will not be complete bty end of december as the only thing being built at the moment is the skeleton of the development IE the supporting pillars etc. And no building was going on while I was there

Hello everyone'
Just a quick update on our refund action, we have now provided power of attourney to our new solicitors who are preparing a case against the builder. I have been told that its a long drawn out process. How are you all getting on with your own action, I would appreciate any feedback that you may have received and I will continue to post updates on our case.

I am going through the process of providing power of attorney to my Spanish solicitors. It seems that there are a few of us doing the same and this will provide greater leverage in the courts.

Hi everyone,
Just wondering how anyone is doing regarding their refunds. Our new lawyers are drafting the lawsuit for us at the moment and we then have to wait for a reply from the developer, is anyone any further advanced than this!

Hello, I have just come across your forum. I am in the same boat as the rest of you with Balcones. I have been tooing and frowing with the Spainish solicitors that iap suggested when we purchased the apartment but I can't get to grips with her answers and explainations about my contract because I like you am after my deposit back.
