It seems that some people and some judges are taking the view that if you bought for investment, tough luck, or if you bought a holiday home, its not great but things will get better.
Whats the difference?
If you originally paid your deposit for a hoilday home, and on completion of the development was advised not to complete without the LFO, you basically have had you money sitting there stuck and more to the point no home to move in too. The arguement is that you should complete, whats the problem? Your going to get the licence anyway or atleast some day you will get it. However, if you had completed and sometime after completion decided that this home is not what you wanted and tried to resell it you would still have the problem of not having a LFO, who's going to buy from you? You bought in good faith but now have to sell in a distressed market through no fault of your own.
Ok, so if you bought for investment, on completion of the development you would have had to pay the balance of you money, thats fine too, IF YOU HAVE ALL THE PAPERWORK IN ORDER, where does it say in LAW or morally for that matter that if you bought for investment you should accept inferior terms and conditions? If you had no intention of living there, why would you complete at all without the LFO? If the licences were all there at the time of completion you would have had to complete and thats it, good or bad. The FACT is that on completion it was not all there, and so you wait. It also never said in the Contract that when the development is complete, you may have to wait until Marbella sorts out its Corruption, Scandals and Political issues to buy or sell a new apartment.
The developers sit patiently in the knowledge that it will be sorted out, but its going to cost them some money, the public as usual, seem to have no say in the matter.
So, to all those that are looking for a righteous or moral arguement against those Capitalist speculators who bought to make some money, WHAT IS THE DIFFERENCE?there is none.
Neither Investers or Occuppiers agreed to buy under these terms, so why treat them any different.
This will be a damage limitation exercise by the govenment and developers while the public will take a hit.
