I am a Lawyer who went to the court several ago against AIFOS because of the delay in this development.
They have a problem in the Town Hall and for now they cannot obtain the building license for the complex.
Nobody know if they will obtain it one day but the main problem is the delicate financial position of them

We have been involved with Aifos since 2004 regarding Torrox Golf Las Calinas. After paying all our payments and not getting any response regarding this development, I travelled to Spain last week to have a word with our spanish lawyer. The advice given was,either try to get our money back with interest which could take years or purchase another of their properties already built and try to get discount. This was suggested as it may be a possability the company may go into liquidation and we might end up with nothing. I am feeling unsure about handing anymore money to Aifos and was wondering if anyone else has taken this route?
If you can give me any information I would appreciate it.

We too have been swindled by Aifos, signing up to an apartment in 2004 like yourself, although we did manage to delay the last two stage payments and have since demanded back our money. We have been waiting for repayment since Feb 2007 and have even had two cheques in our hands from Aifos for the refund, but both times they have not honoured them, telling us that they do not have the funds available. This has cost us money in rejected payments and a great deal of anguish and frustration. We did have contact with the Manchester office but they seem to have disappeared ! Wonder why? They have also tried to fob us off with apartments that are already built, mostly ones they have got left trying to make out that we will benefit as we will only pay the same as was quoted back in 2004. That is all well and good but there does seem to be a problem selling apartments in Spain at the moment so you may be stuck with something you do not really want. We do not want to hand over another penny to that company and have taken the matter up with a solicitor who is taking our case to court. He is hopeful that they will settle out of court to keep face, althougn their reputation is already very poor after reading several other articles about them on the Internet. We can only be hopeful that we get our money returned...our solicitor advises that he does have other clients in the same position so we are not alone in this.
We still hope to move out to Spain this year, but will be very careful of any future purchases! The whole thing has been a nightmare but fortunately not dampened our dream of moving out there. Good luck to you

We've been done over by Aifos too - Las Colinas. We made the stage payments and became worried when no sign of building started. We are now on our second lawyer who appears as ineffective as the first. I wonder if there's any point trying to get anything back becaue I hear of so many people who've apparently won their case but been paid nothing. I wonder if a class action is the answer but don't know how to access other people in the same situation. We're now being offered other properties - either not started or horrible and more expensive. How do we unite in fighting this?

I was in the same position as yourselves, I asked Aifos to look for another appartment. They did and we moved into terrazas del sol, Riviera del sol Mijas in December lastyear and couldnt be happier. Aifos were a pain about the torrox site, but have found them great with our Mijas pad.

I do have great sympathy for anyone who has paid a deposit for this development. It sounds like it is proving very difficult to get any response or repayment from Aifos, but if you get the chance I would urge anyone to pull out if they can. I have lived in this area for a number of years and the building boom on the costa has produced countless half-finished blocks of apartments and they are hundreds of properties now for sale in the Torrox and Nerja area as the recession here takes hold. I do wonder if the promised green areas, shops, golf courses etc will ever be built at this site and at the Calaceite development. Nearby areas such as Torrox Park have countless properties for sale and the so-called commercial centre is bereft of any shops. I almost bought off-plan myself once but instead decided to buy something that already existed so I could see exactly what I was getting. Not much use to those who are trying to get their money back, I know, but I do wish everyone in that position the best of luck. Unfortunately the market here now is very different to when these properties were first marketed.

We too have been ripped off by Aifos. Contact is difficult at best and even when we suggested another property they where not very forth coming. Although we are grateful for that, as at least we have limited our loses.
We are currently looking for a lawyer to persue our case but have been asked for 8000 euros up front plus 10% of our awarded amount with no guarentees. Does anyone reading this have experience with a lawyer they have been satisfied with during their long battle with Aifos.
Appreciate any information relating to this subject and the Aifos Puerto Golf Las Colinas.
