Has any one taken a bank to court for non-payment of community Fees

The community which I am a Vice President off is in a dilemma.The problem is that the Banco Popular has taken over the ownership of a large number of apartments and as i understand it is now responsible in law for the outstanding community fees owed and are refusing to pay them. The bank is saying that the reason why they are not paying the outstanding fees is that the apartments are not directly owned by them as they have put the apartments into a holding company. The court award the bank the apartments earlier this year. we have tried everything we can to get the bank to pay with no avail. At the same time we are being put under pressure by Fuengirola Town Hall to complete the installation of an environmental waste unit which was a condition of us getting the Licence of First Occupation and they are threading to charge a monthly charge of 600 euros for not meeting the timescale they set. As you can imagine this charge will cripple the community financially. Is there anything we can do to get the Banco Popular to pay up.
