Hi All

I would like to enquire as to what exactly are the president's esponsibilities. I think that at very least we should be given his contact details, which we haven't and the community are getting a bit fed up with things, as am I and we need to sort out some issues. If this has been covered before then apologies, but any advice on a very newly started community would be greatly appreciated.

The president is the legal representative of the community of owners. If you have legitimate concerns about the community, you should be able to present them to your president, who together with the assistance of your administrators should  try to resolve these issues. If you cannot even get in touch with the president, perhaps things need to change! Do you at least have a contact number for the administrators? If you are in contact with enough other community members, you could consider requesting an extra-ordinary meeting to get things sorted:

Horizontal Law, Section 16

1. The meeting of the general assembly shall be held at least once a year to approve the budget and

the accounts, and in any other time the president sees fit or upon request of 25 percent of the unit owners or

a number representing, at least, 25 percent of the assessment quotas.

Are you prepared to find yourself voted in as new president? Think carefully before taking up the fight!

we are just starting out  but are hitting problems that we are trying to resolve at the moment. Your advice is much appreciated, I will pass it on to the rest of the community as there are a lot of us in touch via e mail.

Two points here:

The Law of Horizontal Property, which sets out the responsibilities of the President and Owners in a community is explained in David Searl's book You and the Law in Spain; if you speak Spanish the Law is available on the Internet.

Fees are an extremely contentious issue. Our fees vary from €800 - €1400 per annum, and some residents tell me this is very cheap and others that they are expensive because they know a community where the fees are much lower. You need to know exactly what is being paid for; some communities, such as ours, have water charges included, also is there any charge to an overarching authority, debtor levels etc. If you're concerned that some charges are excessive ask for competitive quotes for services for discussion at the AGM.
