Our statement above is not the case but waht the Ground Act 2008, requires for Notaries before authorising publics act where a building is declared as finished, before first trasmisssion of the property ( from developer to buyer).

Did your seller infor you that there was no FOL?

Maria,

  Yes I was aware no FLO was available, as the property was over 20 years old and in a central well established urbinisation in  Playa Flamenca, and the property has been bought and sold several times over this period without any request or demand for FLO, I felt comfortable and when I enquired at Town Hall they checked the records which only go back 8 years, and it was they who suggested that I go down 2nd LoO route.

I have no intenton of selling property but would like some paperwork in place for the future, so therefore would 2nd FoO offer the same proof of property legalisation as FLoO ????,

 

If you feel uncomfortable answering this in general forum I would understand.

 What local town Playa Flamenca belong to?

In that case, yes, just follow the advise of people at the Planning department and request the Second habitation License. The age of the building and first transmission,and subsequent ones  put the property under a regime by which just the application of second occupation License is necessary.
