Euro Weekly News: THE Malaga Provincial Public Prosecution is seeking a nine-year prison sentence for the former president of the Capistrano Playa de Nerja community for alleged embezzlement. Between 2006 and 2009 the 51-year old Briton allegedly cashed several cheques to the amount of €31,980 under the pretence of paying for jobs that were never actually paid, the prosecution claims.
In his capacity as president he was responsible for receiving contributions for the maintenance of various apartments; these cheques – amounting to €26,592 - were then supposedly not handed over to the community.
He was also accused of coercing neighbours to sell community garage spaces that were not theirs and keeping money that was left by a neighbour to pay inheritance taxes.
He allegedly acted as a mediator in the sale of real estate in which he received €30,000 despite the sale not being concluded.
He was arrested in May 2009 by Guardia Civil.
Prosecution has also asked that the defendant pay €31,980 to the community and €119,746 to eleven of the property owners.
Meanwhile, the lawsuit against him filed by the community seeks a 12-year prison sentence; five for misappropriation of funds, five for continuous fraud and two for falsification of documents, as well as a €300,000 compensation payment.
