Returning Resident Cert
The Comments |
Hi Guys,
We currently live in the Orihuela Costa area. We are returning to the UK for good next month as things have not gone to well for us this year.
My Partner and I currently have Green Resident Cert's which makes us Tax Resident here. I need to revert this status back to non-resident as we will no longer live in Spain.
I know how to remove us from the padron and return our SIP cards but unsure how to change our status.
Does anyone have any experiance in doing this? Any help would be appreciated.
Thanks
Dan

Simple, just return it to the officer where you got it (or your local documentation office of the National Police where you now live if you have changed area) and complete the simple paperwork. That cancels the Registration.
I would assume you will then need to inform Hacienda, you be leaving Spain and taking up residence in UK. You will need to inform the HMRC in UK, they will probably liaise with Hacienda.
But remember that tax returns in Spain are made in June of the year following. So next year you will need to make a return for 2013 from 1st Jan until the date you leave.

Returning the Green Certificiate does not make you non-resident for tax. Also, you need to declare your income for 2013 for the whole year, not just to the time you leave, Spain doesn't have a split year system , the same as the UK. You can of course offset any tax you pay in the UK.
The way to deregister from the tax office is to complete modelo 030. If you are lucky, they will just accept your form, if not, you may have to provide a cerificiate of fidcal residency from the UK. This is very easy to get, you can apply online these days.

Surely it is better to wait until you are safely on UK soil before you cancel residency and medical cards;if you deregister during your last days in Spain and become ill or have an accident ( may be unlikely, but it can happen)you will be in no man's land as you will not be entitled to free state care, and have no other means of obtaining care other than paying yourself;this would be very expensive. Is there no way you can post the cards back, asking for certificates of de-registration to be sent to you, or can you give permission to a solicitor or gestor to do this on your behalf?
With regards to the deregistration of tax, this could be done by your accountant, and the proof sent to your UKaddress.
