Hi everyone!
My name is Karen and I am delighted to have found your forum as I am in need of sensible advice please.
My husband and I are trying to buy a rural property in Valencia and seem to have hit a brick wall. Our solicitor is reluctant to act for us on a rural propertty we have found as she seems concerned that we may get caught out by protected rural status but as far as we can see most isolated houses for sale are on this sort of land. Her best recommendation is to buy in a village instead but surely there must be some way we could live in the countryside. Any ideas please?

On the face of it your solicitor is correct. I wonder if the solicitor actually knows the particular house is on protected rural land or is simply generalising. Yes there are rural properties built correctly and fully legal. But there are many properties that have been built illegally and all to often it's only when someone in the town hall decides to raise the issue, by then it's too late.
Why not get a second opinion from another specialist solicitor. Or if you are able to visit the area go and ask local estate agents , visit the town hall or other property owners, depending on your ability to converse in Spanish.

You pay your solicitor to keep you safe, they always look for the worst case scenario, because sometimes the worst happens and you would not be very happy if you had not been alerted. I like broph's suggestion of a specialist solicitor, if I were you I would ask your solicitor to suggest and work alongside a specialist solicitor. Also I agree about you going and doing a bit of digging around, talking to local people, and town hall staff could have results.

If the house you are trying to buy is built on protected rural land it does not have planning permission and should not be their that is why it is cheap I have read a lot about people buying this type of property and trying to sell it 5 years later like you're finding out it is impossible to buy or sell walk away if you don't you will be back on hear a little bit further down the line telling people that you have been conned when you new exactly what you were getting you self in to you no nothing about Spanish law the solicitor you are employing is giving you good advice walk away l bought a new build property and made sure it was fully legal by using a good solicitor the person that bought the house next door to me did not he paid £185.00 in 2007 for exactley the same villa as me built by the same builder as mine yet his is classed as a illegal build they have also spent over £30.00 trying to make it legal and it is still empty with no one living in it.

Any property anywhere without the correct legal governance is by definition illegal and liable to demolition. In Valencia province it’s particularly difficult to legalise property built on rural designated land. The vendor is trying to off load a head ache on to unsuspecting buyers and seem to have convinced you they know better than a legally qualified professional. Do not touch it with a barge poll.
You have a good lawyer, take notice of his advice. In the past less than honest lawyers in Spain would have led you up the garden path. Do some research about all the illegally built properties on rural land in Spain and the consequences for their unhappy owners.

So whats "Inciting" about advising someone to take advice from people who live in Spain on a full time permanent basis, at least they should know the rules and areas, as opposed to the casual house owner / visiter who doesn't know that much, only about the beaches, bars and shops....Including myself.

Seams to be alot of edited post of late from eos_moderators---- i had one edited the other week telling of a car show room, i had done this post over the last couple of years and it was never edited, maybe we have a new kid on the block in the moderator dept.

Apologies in advanced as this is going off thread
From my viewpoint it appears that a certain person(s) seems to have some influence over the moderator or simply complains more than the rest when it suits
Sounds a bit like the old sayings "can dish it out but can't take it" and "is never wrong!!"
Maybe this will get deleted / edited depsite I have nmot incited or named anyone but we shall see

Yes well, please keep posts on thread and please let us remind you that it is not necessary to insult someone to incite them into responding negatively. We do not need to justify our editing either, it is our interpetation, full stop. However, If you feel your post was edited wrongly feel free to PM us and challenge the 'edit'. However, we doubt very much that any post in this thread will be challenged as we all know full well who the 'edited post for incitement' was intended for, as it was directly related to another post and silly bickering on another thread. There are no new kids on the block, just patience running low. If you do not get on please do not react to eachother in the thread, be civil and avoid insinuations and disguised insults, all you do is knock the thread off course and waste everyone's time.
There are many reasons why a post could be edited; a company may report it, lawyers may contact us, other members may feel offended, we may consider it unnecessary, or in bad taste, the list is endless. Some do slip through the net and are edited later in time though. But as said, if you wish to challenge an 'edit' please do via a PM to the moderators, so not to distract the content of the thread. This is a very intersting thread so please don't spoil it with silly remarks.

Don't disregard you lawyers advice lightly!! they seem to be putting your interests first even over their 1% fee
I'm sure they would have asked for a Nota Simple (extract from the deeds escritura) this would of provided the following information
Any debts
The current owner
The boundaries and the total size, Rights of way etc
If it's classified as Rustico, Urbano or Urbanizable
No deeds no deal!

Other than unexpectedly discovering that you are the beneficiary of a fortune, no lawyer ever tells you that they have great news for you. No lawyer worth his/her salt ever gives a purchase a competely clean bill of health, there is always something to double check, however if they tell you that they have bad news, you had best take good note of it.
I have no idea of your circunstances, but if you require a mortgage then the purchase has to be mortgageable, if you're a cash buyer it's a case of 'let the buyer beware'.
