we live in a quad appartment upstairs and my water pipe is underneath the downstairs quad garden and has burst. My question is, does the community pay for this or am I liable to go thru my insurance to dig up the downstairs garden to fix pipe and replace tiles

That would depend on what insurance your community has. Check with the president or administrators to see if it's covered.

Normally you are responsible for leaks between your water meter and your property.
