If anyone watched the drama 'Alan Bates versus the Post Office' recently, and the sub postmasters fight for justice, you may have thought, like me, the striking similarities between their predicament and those who placed and lost deposits in the noughties on off plan Spanish properties.

Big companies with deep pockets versus the small skint people!

Keith Rule was an amazing champion to fight for rights against the Spanish Banks.

You will see from the educative petition detail that it started in 2010 and closed in 2012.

Since then there have been all manner of threads on EOS ( including some within the Communities section ) that have tried to educate and address the ongoing legal complexities associated with Ley 57/68, the law intended to protect from the outset of offplan purchase. 
Many of those threads in the interim years called upon Maria de Castro for educative advice and updates to comprehend the legal procedures and the many complexities associated with this law. 

Suffice to say that one of those threads acts as just one example to highlight what some of the Banks have been doing and the need to provide adequate disincentives in the lengthy interim period since the Bank Guarantee petition closed in 2012.

Hopefully this might help (at least in part) to comprehend how the Banks have behaved in the intervening years, and how some might suggest have purposefully sought to exploit a justice system already overloaded and under funded to their own ends.

 Court Strikes in the interim ( ended in July 2023) have also exacerbated the situation, but as far as we can comprehend these appear to have left existing claimants and law firms to contend with an even greater backlog.

The need for highly knowledgeable law firms to effectively address all outstanding "elements of doubt" associated with Ley57/68 cannot be stressed enough however. Only when supportive legal doctrine has been achieved at the highest level (Supreme Court) with regards to ALL outstanding "elements of doubt" associated with Law 57/68 can claimants be sufficiently reassured. All too many are still awaiting FINAL rulings and actual return of their monies ( including interest and costs) however. Sounds familiar?.

And in the interim all we can do is await further educative legal updates from those best placed to advise and reassure.

Does the Spanish media broadcast and publish the injustice and unfairness of all those guilty of it, or are they in the back pockets of the corrupt?

Very difficult to assess Kavanagh but this article titled "The Role of the News Media in Fighting Corruption Practices: A Case Study of Spain" from 2021 suggests not.

Having said that transparency international have identified the following

The difference between the Banking scandal in Spain and the Post office scandal in the UK could well be associated with the proactive campaign in the UK ( now nearing one million petitioners ) that followed the TV drama documentary series that rightly brought this painful story of abuse to the attention of the UK media, Jo public and Government alike.

In terms of the Spanish Banking scandal, so much has depended upon an educative process...

Within EOS the aim has been to try and provide greater understanding of the many complexities relating to the Bank guarantee scandal, to ask questions in order to gain greater clarity to comprehend the legal procedures associated with the fight for justice, to gain updates on progress made, and where appropriate to identify the many uncomfortable realities and impacts along the way associated with Banking ploys / challenges that sadly have had the potential to undermine the establishment of Supreme Court Doctrine so essential to gain fair and supportive judicial rulings, let alone the significant  judicial and court delays that have also inhibited timely justice ( and in essence undermined the rule of law).

 

Not easy by any means but reliant over the years through EOS upon engagement with those impacted first hand and legal professionals (most notably Maria de Castro) who thankfully has been willing and able to provide that essential educative detail so necessary to put into perspective the many hurdles that all too many claimants and law firms have encountered during this last decade and beyond. 

But also never losing sight of progress made to date whilst highlighting the ongoing endeavours still required to make the Banks fully accountable according to law. 

 

For all of the above I have to give personal thanks to Maria ( and Keith Rule) and their commitment to providing wide ranging educative detail, without which many would be working blind, but also the unceasing commitment to fight for justice under all manner of challenging circumstance and hopefully strive to improve the justice and administrative system in that process. 

For many, a long way still to go however!

It seems a sad and unprofessional situation when democratically elected governments only acknowledge the truth and gravity of a situation when it is forced upon them by the media and public opinion. In almost all cases the government is fully aware and informed of these wrongdoing events but chooses to ignore them. It would be interesting to know what the electorate thinks about this corrupt behaviour.
