Hi Ken

Not sure if there is any legislation that covers this.  The size of the pool will not make a difference to the rules only the fact that it is Communal against private as there are no such rules governing private pools at the moment, but many covering Communal pools as I am sure others on here will agree.

We on our Urbanisation in Villamartin Costa Blanca, are governed by the rules set at the Annual, or Emergency General Meetings decided by the majoriity of owners or by the terms of our insurance policy and this limit has been set at the age of 10.  This is mainly a common sense measure as small children without supervision and deep water do not mix.  The rules of the pool have to be displayed in Spanish (and then any other language thought appropriate)  to become a legal requirement.

Hi Ken, can you tell us, out of interest, why you are asking ?

On our community anyone under 14 has to be accompanied (supervised) by an adult or our community insurance will not cover for if anything happens to them. (I've got our community pool rules in front of me).

Often families go to the pool to meet with other families & all their kids are doing their own thing & the parents, whilst around, don't seem to care tuppence what they get up to. It spoils others time there. We actually pay a lot to own on our community & often these are renters who feel able to do just anything they want at the expense of others &, if you dare to ask them to stop doing something clearly against the rules which are posted inside area, we often get a mouthful of abuse. The kids run around the edge then lsaunch themselves in the deep end, put the biggest lilos in the pool, eat & drink though shouldn't. Maybe we should've just rented a property for 250€ a week in May instead of ploughing almost 200,000€ into our property opposite the pool. Oh yes, we have to listen to screeching day after day too, forgot that.

Rant over.

The legal requirements for lifeguards in pools depend on the size of the pool and not on the age of the users. Those are parental duties or as much... a matter to be discussed and agreed in by the Community of Owners.
