apartment fire and precautions

Hello all

The property agent who minds my apartment for me emailed me the other day with the story of a woman who was letting her apartment long-term. There was a fire in her apartment due to a faulty chip pan and the tenant died due to smoke inhalation. When the owner flew over to Spain to sort it all out she was arrested on arrival.

So, my agent is saying I should buy all these smoke alarms and fire extinguisher and stuff. Now while I think I will do that anyway as it would be awful if something happened, I'm concerned about the woman this happened to and have been trying to google it to find out but can't find anything.

I've asked my agent for more details and they haven't come back to me.

This has made me a little suspicious of my agent.

Has anyone else heard this story and know anything?

no idea - the agent just said recently - I've emailed him again for more info but I can't help feeling there should be some information when I type into google

We haven't done it yet, but the intention is there (full of good intentions me!!). We will be putting in a fire blanket, small hand held extinguisher and a battery smoke alarm. We wanted to do it before we had any rental guests, but didn't get around to it. Persoanally, I think it is the responsible thing to do (whether required by law or not) for peace of mind to your property and for your guests. If you have gas in the property, a carbon monoxide detector would be advantageous too.

The first thing we did was to put a fire alarm in our apt we brought it from england with us it has a 10 year batteries life , as we are on the ground floor apt in spain we have a big fire extinguisher out side by our front door so i did not need to but one for   inside but a fire blanket would be a good idea  for me to buy .All This has to be done if you rent out in england and you need buisness insurance in england as people can sue and they will in spain if somethink goes wrong bye irene

Having now read the blog, there are some questions.

We have buildings, contents and are insured 3rd party liability for our guests. We also have a top floor apartment. Who is responsible for damage if the fire began below, behind or next door?

Hi

Having experienced the awful situation of having a fire in my apartment and then having to deal wtih the consequences I learnt that:

If you are in a complex and pay community fees then a percentage of your community fees is paid towards a communal buildings insurance.  I had buildings insurance and had to give my details to the communtiy office.  Both the assessor of my insurance and the community insurance came to look at the damage and all claims from surrounding apartments had to be put into the community administrators.  The assessors had to agree on a payment for my apartment, the communal areas and any other claims from the apartments.  My fire had damaged the rug of the apartment above (smoke damage) so I simply told them to put the claim into the community office and the claim would be put to my insurance and the communtity insurance assessors.

i have to say that I didn't know any of this though until I had my fire so it is sometimes worth checking out with your community administrators.  

If you are renting out your apartment I would always advise builiding, contents and 3rd party liability insurance.

I have spoken to people about the pros and cons of fire safety equipment, I was told that in Spain it is not required by law but if you put in such items and they are not checked and serviced regularly then if something happens and it doesn't work correctly you can be charged for the failure to maintain such items.  So just be aware that if you put up a smoke alarm and you don't test it and a fire breaks out and the smoke alarm doesn't work because the batteries have ran out then you can end up in more trouble than if you had not put one in the apartment to start with.

In the complex where I had my fire there were no smoke alarms anywhere, the fire brigade had to knock on doors to get people out of the block, as a consequence of this the community installed smoke alarms on every landing and by every lift shaft.  So sometimes it may be better to suggest that the community provide fire safety equippment and then they can maintain it properly.

I too find the Marbella story a little far fetched.
