IS MY POA STILL VALID??
The Comments |
If you take out Power of Attorney with a company with named solicitors and it goes bust and one of the named solicitors starts up on his own - Is your original POA still valid?? If he takes your papers with him - Is that legal also.
We had no notification of the original company going bust and all emails unanswered. Then our original solicitor informs us that he has started up on his own and has our files.
Any legal advice would be appreciated

Dear Jay:
It will all depend on the exact wording of the POA. I will be able to give an answer to you if you send it to me for my perusal.
Anyhow, if you want him to give the file back to you for any reason, you are free to do it and he is obliged to release it according to the rules of the bar association, previous liquidation of fees owed.
Best regards,
Maria
