Perhaps I should explain my enquiry.
We have an owner in our community who does not pay his community fees.
However he does rent out his property on a permanent basis.
I suspect that this is a major problem throughout Spanish Urbanisations.
That is owners who do not contribute to the running of their community but they do use it to the fullest extent.
The law as it stands is very inadequate in dealing with these cases. The procedure of denuncia to the courts is a long slow process that does not always guarantee a result. In the meantime the miscreant continues to earn money from his property.
It is also a fact that the original owner may have sold the property on to a third party and our administrators do not know who or where the new or even the original owner is. Perhaps it is not within their jurisdiction or interest to investigate.
It is however a very frustrating and irritating and costly problem for the paid up members of a community. Particularly as the law as it stands does not permit the community to take independent action against the owner or the renter by refusing them access to the urbanisation.
Your knowledge and advice would be most welcome by many communities.
