Legal tip 393. New case won: Cadiz Courts backing consumers again!

 At home with flu, I received a wonderful new about Cadiz appeal Court confirming the abusive character of a penalty clause in an off-plan purchase contract and reaffirming rights of  Consumers to devolution of a 95% of amounts paid if, due to breach of the buyer, the developer cancels the contract and keep an amount as a penalty.

It is very important this doctrine line is consolidating.

Good news María.

The developers have been very good at including abusive clauses in Sales Agreements which are very much against the consumer.

But what were all those conveyancing Lawyers doing over the past 10 years - allowing the purchasers to sign contracts weighed so heavily in favour of the developers? Conflict of interest comes to mind.........

When the Mayors,Ministers, and other high ranking figures are corrupt no one is safe - the Suicide Bankers, Abogados, Notaria down to town hall employees also become part of "A System of Mas Financial Destruction" and create traps for those thousands of home buyers who were already trapped in an environment created by the Estate Agents who were also entrapped by the huge commissions with no redress.
