2 and half months for succesful execution of Bank Guarantee
Friday, November 14, 2008 @ 12:46 PM

Who said that Bank Guarantees cannot be executed and if executed, it will entail long and costful processes?

Just for your peace of mind and  to somehow restore your faith in the judicial spanish system:

It has taken 2 months and half for one of our clients ( we already have the money in our bank account and are transfering it to him, early next week)  and have costed him nothing as the Judge has imposed the Guarantoor to pay legal fees.

Is that on a bank guarentee that has been issued by a builder who has since gone into administration ie. San Jose. If so give me your details and I will gladly employ you to get our money back. Sincerely Dave & Linda Butler

The execution of the Bank Guarantee is independent from the financial situation of developer. Yours is same excutable and as being in Murcia jurisdiction much likley to have same effects.

We would be pleased to assist you, just email us to: mldecastro at costaluzlawyers or marialuisa at costaluzlawyers.es

Thanks a lot,

Maria

Maria, we have been waiting for Bank Guarantees from Polaris World for 15 months. Our solicitor assures us that they will arrive this month, although I don't hold out much hope. Can you please advise why this should take so long??

It should not take so long, it needs to be handed at the same time you pay money. You can act for contract cancellation due to the lack of this guarantee.
