AENA Spanish Airport Authority explains rules on Duty Free bags

It seems some airlines, not named by AENA, have been treating passengers differently.

Spanish Airports Authority, AENA has said that low cost airlines cannot charge for carrying the bags of duty free shopping.

Without naming any airline in particular they say that discrimination is only justified for the safety of the aircraft. 

 The AENA statement said ‘To all air companies without exception, we remind you that current legislation ‘allows passengers to embark on the aircraft carrying the products purchased in the airport shops and correctly packed’ and that their transportation as hand baggage ‘must be carried without charge’.

AENA also notes that article 97 of the Air Navigation Law says ‘Airlines are obliged to transport, with the passenger, and included in the ticket price, the luggage within the weight limits, independent of the number of packages and volume, fixed in the regulations’.

Another regulation says ‘The airline is obliged to carry, and for free in the cabin as hand baggage, the objects and packages which the traveller carries with him, including the articles acquired in the shops of the airport’. It continues that only objects which represent a security risk linked to size or weight can be rejected.

AENA Airports recommend that passengers ‘who see their right to embark limited’ for carrying duty free items, to make a corresponding complaint. Any inspection is the responsibility of the AESA, The State Air Security Agency.

Ryanair has a 10 kilo limit for hand baggage along with regulations on size and the bag must include the articles purchased in the Duty Free. The airline charges 50 € if that is not so.

I know for a fact that at Alicante airport both Ryanair AND Easyjet INSIST you only have ONE piece of hand luggage as we saw Ryanair getting into an argument with some who were carrying goods they'd just bought in the "Duty Free" & we were getting onto an Easyjet flight & were all told we had to put any extra bags inside one bag. It caused chaos as many had bought from the "Duty Free" shop.

This is obviously badly written law which Ryanair's lawyers will demolish. It implies you could buy ANY quantity of stuff at airport shops, even to the extent of having shop staff deliver it to the gate by forklift, and the airline is obliged to carry it free.

Duty Free sales do not exist for intra-EU travellers, the consequence being that none of these goods need to be purchased outbound from an airport at all. They can be sold off-airport, online and delivered anywhere includinh on arrival. Do people go to an airport to shop, or do they go there to catch a flight?

Guy ..... Your interpretation is incorrect when you say that "it implies you could buy ANY quantity" even a forklift load being delivered by staff. WRONG! ... If you read the regulations you will see that "Hand Baggage" and "carries" are the operative words.
I agree with SMITH about whether people go to Airports to shop or fly and I found it incredible that the shops at Manchester Airport were selling 32" Televisions .... How can that be "hand baggage"

I'm with Ryanair on this, the reason they stipulate bag dimensions as well as weight is so that bags can safely be carried in the overhead lockers. Multiple odd shaped bags take up far more space, take longer to store (delaying take off) and results in people boarding last being unable to find space for their bags, which then have to go in the hold.

Low cost airlines serve a purpose, to get people from a-b as safely and economically as possible, whilst still making a profit, which is perfectly reasonable.

As stated, who goes to an airport to shop anyway? The goods are seriously overpriced and its just the airport authorities worrying about their profits that has brought this about - nothing else. If people have to buy at the airport, leave room in the bag!

y wife was stopped and told to put her handbag into her hand luggage so she took her coat out of her luggage put her handbag in then reversed the process after passing through check in. While she was complying with the check in assistant several other women walked past them carrying handbags and hand luggage. If they are going to enforce this stupid rule then it should BE ENFORCED not just the odd person made to comply causing annoyance to them.

In 2011 while flying to Teneriffe, I was stopped by Monarch as lentils in my hand bag resulted in half Kg overweight. Upon objection by Monarch staff just before borading, right in front of her eyes, I put that packet in my jacket. I was allowed to board. Just use common sense.

I think you just have to accept that a low cost flight will not always be a trouble-free experience. Recently was witnesses a complete boarding shambles as disabled passengers and those with babies were asked to board somewhere in the middle of the boarding sequence (instead of first). As we boarded we were given a public dressing-down for carrying a newspaper in a carrier bag when it should have been in one of two permitted bags.

Again we have the airports saying one thing and the airlines saying another. It does not matter at all what the Law says as the airlines have the right to remove, and also have arrested, anyone who disrupts their smooth running. You can argue as much as you like but if the airline staff decide you are "aggresive" you will not be able to fly. Also the one bag rule is for safety and comfort of the other passengers. If a selfish passenger takes his 1 bag and then insists on taking his "duty free", which might be the same size as the allocated bag, then it means that another passenger will not be able to use the lockers for his 1 bag. The simple answer is if you fly budget airlines then you have to compromise on service, space etc. If you wish to take lots of hand luggage and lots of "duty free" then use the non budget airlines, simples!

Well, they would say that wouldn’t they. Another corrupt one sided rule by Spain parasites. They must think Billy Brit is brainless.

This time Ryanair have got it right (10kg all in one bag) end of. What’s it got to do with AENA what an airlines baggage policy is? Sod all.

All that over priced crap in the airport is half price down at Tesco’s. Plus there’s no such thing as duty free within the EU. It’s all bullshit. And even outside the EU it’s still cheaper down the supermarket.

I am not mad about shopping and it might be true that you can find the same stuff cheaper in any shop, but at the same time it is my right to decide on that

Freedom of speech does not mean that I have to be talking all the time, but I have the option to speak my mind about any interesting topics

I believe Ryanair is breaking the Law taking this kind of actions, so hopefully there will be enough complaints to make them change this policy
