Hi all,

Just returned from Las Dunas, where we were greeted by a bill for the community charges. Has anyone else from Blocks 6 or 7 or Duplexes 21 to 25 received theirs yet?

It appears that this exclusive group of owners belong to 2 communities! The general community, consisting of all 175 properties and another community for "Phase III" properties.

I am waiting for the administrators "Gesisur" to explain this, since we have to pay into both communities, which makes our charges around double those of the non-phase III owners. 

Does anyone else know what this is all about?

Hello again,

Gesisur have just confirmed that each Phase, I to V, is its own separate community as well as being part of the General Community. We all therefore have to pay two lots of community charges.

Surely this takes a lot more administration effort - and cost - than if we were all part of just one community.

Does anyone else agree?

We are going to the Notary on 28th of November to hopefully complete the purchase of an apartment in Bloque 15, we are quite concerned about the possibility of  "belonging" to two communities and paying two lots of charges. Who is Gesisur? and how do we contact them? Ideally we would like some more information before we go out on 26th

We completed in August and only found out that Gesisur existed last week when went went to our apartment for a short holiday. It seems that they are the administrators of our community (ies)!

I'm not sure how the community can have appointed an administrator when most of the owners haven't yet completed, but it seems a "done deal". The only contact I have at Gesisur is from the documents they left under my door in an envelope - it's jose.carrillo@gesisur.com. He has promised to send me the minutes of the last "General Meeting", which it seems took place without most owners knowledge! I can't imagine who attended!

Hola,  Just been reading about some of your messages and replies concerning  the Community and its running.  If you read my thead entitled Problems (x3) we visited GESISUR offices in Aguilas early in October.  They are in the Calle Floridablanca just 100m east of the main square,a modern building (No 9a) on the third floor. The contact there is Jose Carillo,who speaks very good English.  In fact it is a firm of solicitors by the name of AVSA Lawyers. When you complete at the Notary you should be handed a folder with all the information about the administration of the community (and it is in English,well most of it) and provides all the rules and regulations governing our urbanisation.  Mainly it is about what WE can and can't do rather than what they can do for us.  That is until a president is elected (by us as I understand) who will liaise with Gesisur in order to put our queries etc to them.  It appears that the elected person must live on site, but will have limited authority.  Gesisur will on payment of 280 euros set up your water and electricity contracts, but as the electricity company requires access to your apt. in order to install a meter at any time you will have to leave a key with Gesisur.  When you visit them they will give you a complete breakdown of the community charges, which you can pay by direct debit if you have a Spanish bank account. At the moment ours is about 38 euros a month, also a one off payment of 40 euros for the garage.  By the way your first payment will include a back dated amount from August when the Community was set up.  If you have any complaints about the state of the urb. let Gesisur know about it, that's what we are paying them for.

Hope this is of some value, also is anyone concerned about the so called Golf Course and its unfinished state???

The golf course is not actually for the residents of our complex (despite what some of our agents have told us.)

Eventually the golf course will be privately run as a business, thus meaning pay per use.

The same will apply to the tennis courts. There is a building under construction which when finished will be the club house for the leisure facilities.

As far as I am aware a "president" has already been appointed for the community of Dunas del Cope, it is worth checking this with Gesisur whenever you speak to them next.

I was told that the meeting which has just occured was the AGM so it appears that those of us which have only just signed or are about to sign wont get a say in the forthcoming years events on OUR complex. I am more than a bit concerned about this! What about you guys?????????

I think this may be worth pulling our administrators about. Please post your opinions.

I am also becoming increasingly concerned about the running of the Community. We were out there and signed at the Notary last week. We were not given any information about the Community. What I know I have found out on this Forum.

I am still to hear from GESISUR.

The news about the tennis court and golf course is new to me. 

I feel we need more say in our complex.

Hola all readers,

With reference to the Golf course and Tennis courts.  I am very concerned to hear that they are not a part of our complex.  This was one of the main reasons for buying here.  I would be very interested to know where this information came from.  As I intend to get our solicitor to chase this up I would like to know if it is genuineor just a rumour.  I have been through the Prospectus of Las Dunas given to us by the builders in their office when we agreed to buy back in 2003. This gives all the design details and drawings of the site, and buildings, and includes a detailed layout of the golf course and tennis courts, they assured me that they would be for the exclusive use of the residents.   With regard to a President being elected and that meetings of the Community have occured.  I understand from the Urbanisation Statutes (Article 33) that all Proprietors (owners) should have been informed by writing of the date of the meeting and its agenda.  Also any agreements made at the meetings must be voted on by the owners,who each has one vote (Article 34). Also all decisions made at the meetings will be recorded and copies sent to every owner (article 35).  Have any of you received anything at all from  Community (Gesisur) about the previous meetings?  I have a feeling we are being taken for mugs.  Are there any you going out to Las Dunas for Xmas.  Perhaps we should get together and sort this out.   Hasta la vista

Hi,

Also very worried that things are moving on without our knowledge.

I was also under the impression that golf and tennis was part of our purchase. I have had no notice of any meetings etc., but I now understand that decisions can be made at the community meetings based on the number of properties that are represented. Therefore if the builder ( or his representative) was there and he still owned, say 100, properties, because the rest hadn't been completed on, then he would have 100 votes.

I feel that our community has been thrust upon us rather than elected by us.

I won't be there for Xmas, but will be from 6th to 10th December. Let me know if anyone else will be there at the same time.

we will be on complex 27th Nov to 3rd Dec and will be trying to get some answers to all the questions raised on your previous postings:

Community Charges, election of a president, AGM, Tennis Courts, Golf etc. and will post what we find out when we get back.  We are also planning to be there 1st to 10th of Jan and would be interested in meeting up with anyone who is there
