To everyone, it may be worth our while to watch the tonight programme on Wednesday 23rd July, ITV 1 at 8pm. "Jonathan Maitland explores the marketing of homes abroad and meets British buyers who fear they will lose their hard-earned cash."  It may be informative, or just another scaremongering programme, but it might be worth watching. Also on Monday, according to Sky programming, I dont know which is correct so I have added both.

Incidentally, we decided to get our money back from the BG's, and apart from the initial e-mail from Aldea we have heard nothing. I expect to have to change solicitors, but thought we would give Aldea a chance to do the right thing first.

I visited Aldea on Monday 21st July to get the original copies of my BG, at first they said I would have to pay a cancellation charge, but after raising my voice somewhat and explaining that they have been negligent, they gave them to me. I then went to Almeria and have given the paperwork to Andersons to execute the BG. Andersons reckon 5 weeks to get the money, Aldea said 6 months, we'll see. It's cost me 1800E but I feel a lot more confident in Andersons than I did with Aldea, their office is next door to Paradors!!

  What is this ''cancellation'' form thing all about. It's complete rubbish and another tiny minded way to try and scam a few €'s from us....

Huma tried that one , and we argued it out . Finally I believe our solicitor took it on board to say that the plot remained in the name of the purchaser until such time the debt is repaid (i.e. all monies refunded) then it is released and the developer can re sell that plot with no debt against it. Which I think in Spanish law has to happen OR a new buyer would take on the debt.......
So, if your plot is ever resold before you have a full refund you could claim on that new purchaser for the debt.. That scares off buyers...
Now, (listen carefully I vill say sis only vunce)
it could get interesting because, if ACC was to get the go-head and Huma start to sell - IF they re- sold a plot purchased by you,  you could actually prevent that re sale until you had been fully refunded all monies....You could hold onto the release of the plot. 

With so many cases lining up to go to court Huma may get caught with their pants down when they try to re sell .......That would give us the biggest piece of ammo to date...I hope this happens. Bet they will want to refund me / us quickly when this happens. Any Solicitors /Lawyers  reading please elaborate on this one.........

However, knowing the integrity as we do, they will have that one covered  !!

Back to the 'cancellation'' form:-)
No one is cancelling anything. What has happened is :
Non - delivery of the property in the agreed contracted time scale and breach of that contract by the developer ! end off. Total refund entitlement.
