Hello all, my first post!
We are currently at the snagging list/final completion stage of our purchase in Block 5.
During a recent visit, the Proindal rep. suggested that the internal measurements are taken from inside the walls! In addition, the balcony is measured from the very outside i.e. beyond the balustrade. This will obviously imply an area larger than that useable.
Has anybody else experienced this, particularly the laughable idea that the our rooms are measured from inside the walls?

Indeed I have experienced this. I had a meeting with my lawyer and the developer at their offices and we were close to taking the developer to court. My balcony was 3sq metres smaller than on the plans. They have said the balcony is measuered from the outside to suit themselves, this is not the case in Spain.
I was compensated with a large parking space and storeroom of my choice,valued at 30k. I was happy enough with this. However the fact is the measurements on the original plans were wrong.
If you feel strongly enough about this contact your lawyer and don't let Proindal bully you.

We have raised the issue (amongst a few others) with our solicitor, & your positive outcome gives us hope. It's difficult not to feel like they try this on as a matter of course, & bank on enough people either not noticing, or being unwilling to get into a dispute.

Hi,
I didn't mention my apartment is also in Block 5 on the 4th floor and the one beneath it on the 3rd floor is the same, too small. It could be a problem ieth Block 5.

Hi,
I raised this and got teh same answer from proindal about the size of balcony. I contact my solicitor and they have said this is normal and tuff basically! Internal sizes are pretty much on the money but balcony was 7m2 short... Now just going to complete as getting no where and MRI solicitors are absolutely crap.

There has got to be something you could do. Talk to a good lawyer about the balcony being short. You should be able to get the price down. The contract that was signed says if the devloper does not complete the contract you would be able to receive your deposit back. I have a copy of my contract and hope yours is the same.

Hi,
Three weeks ago we visited Almerimar to check our Portofino apartment before completion.During our visit we measured the apartment size and found that the living area was about 6% smaller than the plan and that we had only one sink in kitchen instead of two in the plan.
In short we asked our lawyer to approach the developer about it and negotiate a discount. The result was that we got a price reduction of about 6% on the price and additional interest free loan for 7 years.
I was told by a lawyer that according to the Spanish law says it is also possible to get compensations after completion (this is actually the normal procedure i.e. complete first and then get compensations) so it is worthwhile checking.

i am awaiting the plans to come through from my apartment, did you all have someone go an measure your apartment for you? if there is any chance of the sizes being small can you expect your deposit back? any info would be great as i am struggling for a mortgage at the moment
